Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on a Whakatu rental property, all Healthy Homes compliance tasks must be completed inside of 90 days.

Beginning on July 1st, 2021, once a new, renewed or varied contract is signed on the Whakatu rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to adhere to each of Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy agreement there may be an additional fine or infringement fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the home they are living in. If the property manager fails to provide the necessary information within 21 days of being informed of the request, they may receive an infringement notification and could be fined up to $750.

Additionally, there is also a penalty up to $900 for landlords and property managers that provide false or inaccurate Healthy Homes Statement of Compliance or other information. The person liable for this fine is the one who is named on the tenancy agreement as being the person renting the property, so it could be the name of the landlord as well as the company that manages the property.

All information in the Compliance Statement needs to be correct at the time that the tenancy agreement is completed, and must be updated through the tenancy period as relevant work gets completed.

It’s important to remember that a landlord who own several rental properties can face even higher fines for non-compliance. The most severe penalties are reserved for serious breaches. Landlords with six or more properties can receive fines of up to $50,000 and as high as $100,000 in hearing claims.

Whakatu Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is a requirement for all Whakatu and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or modified tenancy agreement.
  • Landlords and property managers must keep records to demonstrate conformance with each Healthy Homes Standards that apply or will be in force during the tenancy of the rental property.

From July 1st 2021

  • Private landlords and property managers are required to ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of any new, renewed or varied tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarder home tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All houses which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.

Proper heating is important to ensure well-being homes

Heating Whakatu

Rental properties in Whakatu should have a permanent heating source that is able to heat the main or largest living room to at least 18 degrees Celsius, even on the most coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat requirements that it be permanently fixed (i.e., not portable) with at minimum 1.5 kW of heating capacity and have the minimum heating capacity needed in the living area. The Heating Assessment Tool can be used to determine if the fix heater(s) are adequate or whether you will need to "top-up" by adding a second heater. Fires that are open and unflued heaters such as small portable LPG bottle heaters are not considered acceptable heating options in the Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump it requirements to include the thermostat. This will help make the heating more reliable and effective. In most houses, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are needed. In certain situations, like apartments with small spaces small apartments, a smaller electric fixed heater may be sufficient.

If the living area already has a permanent heating source like the heat pump, it may need an update in order to comply with the standards. Certain types of heaters cannot be utilised to meet the standard as they are either inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Whakatu

Every living space of the rental property should have at least one opening window or exterior door to offer natural airflow. In addition, high moisture spaces like kitchens and bathrooms must have a suitable externally vented extractor fan that can take moisture away.

A ventilation standard is all about recognising how dry air will be much easier to heat and that a well ventilated rental property is less likely to grow damp and mould.

Living rooms, bedrooms, kitchens, and dining rooms are considered to be liveable spaces. Connecting spaces such as the hallway are not considered living spaces and therefore are not require an opening window or door.

Insulation for underfloor and ceilings is mandatory in all rental homes from 1 July 2019. Property managers and landlords are required to ensure that the insulation is up to the new standard. In certain situations, the current ceiling insulation, or the insulation of the subfloor space may need to be filled with or replaced.
