Rental Property Healthy Homes Fines
Fines for Failing to Comply
As of 1st July 2021, once a new, renewed or varied tenancy is signed for a Hawkes Bay rental property, all Healthy Homes compliance work must be completed by the end of 90 days.
Beginning on July 1st, 2021, when a new or renewed tenancy is signed on the Hawkes Bay rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.
Inability to adhere to any of the Healthy Homes Standards by the end of the period of time expected can lead to an amount of $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not included within the renewal, new or revised tenancy agreement it could result in an additional penalty or infringement fee.
Any tenant may request information regarding the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager is unable to supply the information requested within 21 days from being informed of the request, they will receive an infringement letter and could be fined up to $750.
In addition, there is also a penalty as much as $900 for landlords and property managers who have provided a false or misleading Healthy Homes Statement of Compliance or information. The person who is responsible to pay this fine is the one who is named on the tenancy contract as the person renting the property which could be the name of the landlord as well as the property management company.
The information contained in the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is signed, and ideally it should be maintained during the entire tenancy, as necessary work related to it is finished.
It’s also crucial to be aware that landlords who manage multiple rental properties could face greater penalties for non-compliance. The highest penalties are given for severe breaches. Landlords with at least six rental properties could be penalised up to $50,000, and even as high as $100,000 in hearings.
Clearly, failure to comply with compliance with Healthy Homes requirements can hit your pocket with significant fines and continuing to be required to comply with the requirements.
