Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed for a Hawkes Bay rental property, all Healthy Homes compliance work need to be taken care of inside of 90 days.

Hawkes Bay Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement in all Hawkes Bay and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate the compliance with any Healthy Homes Standard that apply or will be applicable to an apartment rental.

From 1 July 2021

  • Property managers and private landlords should make sure their rental properties conform with the Healthy Homes Standard within 90 days of a renewal, new or a change in tenant.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All houses that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.
