Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied contract is signed on a Waipukurau rental property, all Healthy Homes compliance work have to be completed within 90 days.

All the information on the Statement of Compliance needs to be up-to-date before the tenancy agreement can be executed, and it is updated throughout the duration of the tenancy when any necessary work related to it is finished.

It’s also crucial to note that landlords who own several rental properties can face additional fines for non-compliance. The highest penalties are given for the most serious violations. Those who have six or more properties can be penalised up to $50,000, or as high as $100,000 for hearing claims.

Waipukurau Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 June 2021

  • Ceiling and underfloor insulation is mandatory for all Waipukurau and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate conformance with each Healthy Homes Standard that apply or will apply throughout the tenancy period of their rental properties.

From 1 July 2021

Starting 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Heating Waipukurau

Waipukurau rental properties should have a permanent source of heat that can heat the living area to at minimum 18degC, even during the winter coldest days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heat needs to be fixed (i.e. not portable) with at least 1.5 kW of heating capacity, and meet the minimum capacity for heating required for the main living space. A Heating Assessment Tool could be used to check if the existing fixed heater(s) are sufficient or if you’ll require to "top-up" with an additional heater. Unflued combustion and open fire heaters like mobile LPG bottle heaters are not considered acceptable heating options in those following the Healthy Homes Standard.

If the heating you provide is electric heating (or heat pump), it should have an thermostat. This will make the heating more reliable and effective. In most homes, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are required. In some instances, like small apartment buildings the smaller fixed electric heater may suffice.

If your main living space already has a fixed heating source like an air conditioner, it could need a top up to meet the standards. Certain kinds of heaters aren’t able to be used to meet the standard because they’re costly, not cost-effective to run, and/or unhealthy to run.

Ventilation Waipukurau

Ceiling and underfloor insulation has been compulsory on all rental homes from 1 July 2019. All landlords and property managers are required to ensure that the insulation is up to standards that are in line with the latest standard. In some cases, an existing insulation on the ceiling or in the subfloor space might need to be added or replaced.
