Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed on a Waipawa rental property, all Healthy Homes compliance tasks have to be taken care of by the end of 90 days.

Since the 1st July of 2021, once a new or renewed contract is signed on the Waipawa rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to meet each of Healthy Homes Standards by the end of the deadlines can result in an amount of $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t incorporated within a new, renewed or revised tenancy agreement there could be an additional fine or violation fee.

Anyone can request information regarding the Healthy Homes Standard and how they are related to the house they reside in. If the the property manager doesn’t supply the information requested within 21 days from having received the inquiry, they can be issued an infringement notice and be fined up to $750.

Furthermore, there’s an additional fine of approximately $900 for property owners or property managers providing a false or incorrect Healthy Homes Compliance Statement or any other information. The person liable to pay this fine is the one who is named on the tenancy agreement as the one who is who is letting the property, so it could be the name of the landlord, or the company that manages the property.

All information in the Compliance Statement needs to be current at the time that the tenancy agreement is completed, and should be kept updated throughout the tenancy as any related work is completed.

It is also crucial to note that a landlord who manage multiple rental properties may receive more severe penalties for not complying. The highest penalties are handed down for the most serious breaches, and landlords with six or more properties could be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

If you fail to adhere to the Healthy Homes requirements can hit your pocket hard, and result in large fines in addition to still having to meet compliance. Don’t risk your rental property call us now and request a house evaluation performed on the rental property you are renting.

Healthy homes are important

What is the reason Healthy Homes Compliance important?

About 1 in 3 households rent the property in New Zealand and Waipawa, and research shows us that these rental houses are more likely to be older, colder, are not as efficient heating, and generally tend to be lower quality than owner occupied properties.

Moldy, damp and cold homes can have negative well-being outcomes, especially for illnesses such as colds and asthma, as well as heart diseases. In addition, people who experience at least four key house quality problems often experience poor life satisfaction and lower mental wellbeing.

Improve the standard of Waipawa rental property will allow tenants to enjoy improved physical and mental health as well as lessen disturbance to learning, work and daily life due to health issues. Your investment will also be better protected from mould, mildew and damp damage, meaning lower maintenance costs in the long run.

Unreasonable Gaps & Holes

Draught Stopping Waipawa

Draughts increase the likelihood of low temperatures inside homes. A damp house will cost more to heat, resulting in wasted energy and incurring higher costs.

If a draught is felt through gaps that are too large or holes that it needs to be sealed.

What are unjustifiable gaps or holes?

If you can feel external air entering or the sound of a clear draught emanating from a crack or a gap, then it is likely to be a gap or crack that needs sealing in any way. Cracks or gaps with large gaps must be permanently stopped. The gaps that exceed 3mm that allow air in or out into the home need the sealing. For example, if the open fireplace isn’t being used, it can cause draughts and must be sealed from. Property managers and landlords are responsible for ensuring that such draughts are squelched as much as possible.

You don’t require to block holes or gaps in the construction. For instance, small gaps around doors and windows may be required to allow for movement of the building as the household heats and cools, to allow them to be closed and opened instead of instead of being stuck. We will examine all windows and doors as part of the Healthy Homes assessment of your rental property.

Proper heating is important to ensure well-being houses

Heating Waipawa

Waipawa rental properties must have a fixed source of heating that can warm the living space to at least 18 degrees Celsius, even on the coldest winter days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heating requirements to be fixed (i.e., not portable) with at least 1.5 kW in heating capacity and have the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool can be used to determine whether the current permanent heater(s) are sufficient or whether you will require to "top up" by adding a second heater. Open fires and unflued combustion heaters such as mobile LPG bottle heaters aren’t considered to be acceptable heating options in The Healthy Homes Standard.

If the heating that you offer is an electric heater (or heat pump), it requirements to have an thermostat. This will help make the heating more consistent and effective. For the majority of homes, bigger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are necessary. In some instances, like small apartments the smaller fixed electric heater might be enough.

If the main living room is already equipped with a fixed heating source such as the heat pump, it may require a top up to make sure it meets the requirements. Certain kinds of heaters aren’t able to be used to comply with the quality as they are either not effective, cost prohibitive to operate or are unsafe to operate.

Every living space in the rental property should have at least one opening doors or windows to offer natural ventilation. Additionally, areas with high moisture areas such as kitchens and bathrooms need to have an externally vented extractor to get rid of moisture.

It is the ventilation standard is all about recognising that the dry atmosphere is much easier to heat, and that the property that is properly ventilated is less likely to be a victim of damp and mould.

Bedrooms, living rooms kitchens and dining rooms are all considered living spaces. Spaces that connect, such as the hallway aren’t living spaces and therefore don’t need an opening door or window.

Each window, door , or skylight requirements to have the ability to open to the outside, but remain at an open angle in order to allow ventilation and fresh air air flow.

All bathrooms and kitchens and any other room in your home with a bath, shower and cooktop or another moisture generating item will need appropriate extractor fans which are vented out to the outside. Our Healthy Homes Assessment service will make sure there is sufficient ventilation throughout the living spaces that includes extractor fans that are suitable in areas with high moisture.

In certain situations, the old ceiling insulation as well as insulation within the subfloor space might require to be filled with or replaced.

Waipawa Moisture Ingress & Drainage

Making sure your rental property is protected from water damage isn’t only about the interior of the building It’s about having to make sure there is somewhere for surface, rain and ground water to go and stop it from coming into the building. When it concerns damp and moisture it’s typically those things that you aren’t aware of that could become a major issue that can cause the property to suffer and harming your tenant’s health.

Rental properties need to have effective drainage for the removal of rainwater, storm water, and ground water. This includes an appropriate outfall or runoff. Making sure the water has a location to go, and also that it can’t linger underneath the buildings is an essential part of keeping your property dry.

In addition to a drainage system to prevent moisture ingress, if your apartment has an enclosed gap between your flooring and ground, a ground water barrier should be put in place if it’s reasonably practicable to do so.

An underground moisture barrier generally a sheet of polythene that is placed over the ground to stop any moisture from the ground from accumulating into the building. It also helps in preventing from causing damage to the flooring insulation.
