Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed on a Twyford rental property, all Healthy Homes compliance tasks must be done within 90 days.

Beginning on July 1st, 2021, when a new or renewed Tenancy is signed for a Twyford rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to meet each of Healthy Homes Standards within the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not incorporated in an updated, renewed, or amended tenancy agreement there may be an additional fine or infringement fee.

If the property manager fails to supply the necessary information within 21 days of receiving the request, they could be issued an infringement notice and could be fined up to $750.

Furthermore, there’s also a penalty of approximately $900 for property owners or property managers who provide a false or false Healthy Homes Statement of Compliance or any other information. The person who is responsible to pay this fine is the one who is identified on the tenancy agreement as the person who is who is letting the property, so it could be the name of the landlord or the property management company.

All information in the Compliance Statement needs to be up-to-date at the time that the tenancy agreement is signed. It should be kept updated during the entire tenancy, as necessary work related to it is finished.

Twyford Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement for all Twyford and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate compliance with each Healthy Homes Standard that apply or will apply throughout the tenancy period of their rental properties.

From 1 July 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of a new, renewed or varied Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must adhere to the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Heating Twyford

Twyford rental properties need to have a stable source of heat that can warm the largest or main living room to at least 18degC, even on the coldest winter days.
