Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed on a Twyford rental property, all Healthy Homes compliance items must be completed inside of 90 days.

As of 1st July 2021, if a new or renewed Tenancy is signed for the Twyford rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to comply with any of the Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if a existing Healthy Homes Statement of Compliance is not incorporated in the new, renewed or revised tenancy agreement there may be an additional penalty or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the home they are living in. If the the property manager doesn’t provide the necessary information within 21 days from having received the inquiry, they may receive an infringement notice and be fined upto $750.

In addition, there is also a fine of approximately $900 for property owners or property managers who have provided a false or false Healthy Homes Statement of Compliance or other information. The person liable for this fine is the person who is identified on the tenancy agreement as being the person leasing the property out which could be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement needs to be current at the time that the tenancy agreement is completed, and must be updated through the tenancy period as necessary work related to it is finished.

It is important to be aware that a landlord who own multiple rental properties may face more severe penalties for not complying. The most severe penalties are given for the most serious violations, and landlords who own six or more properties could be fined up to $50,000 and as high as $100,000 in hearings.

Twyford Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory for all Twyford and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords must keep records of their the compliance with the Healthy Homes Standards that apply or will be in force to an apartment rental.

From July 1st 2021

  • Property managers and private landlords have to make sure their rental properties comply according to Healthy Homes Standard within 90 days of any new, renewed or varied tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All households let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.
