Fines for Failing to Comply
From the 1st of July in 2021, when a new or renewed tenancy is signed for a Twyford rental property, all Healthy Homes compliance work must be taken care of within 90 days.
From the 1st of July in 2021, if a new, renewed or varied tenancy is signed on a Twyford rental property, all Healthy Homes compliance work must be taken care of within 90 days.
Failure to comply with all of the Healthy Homes Standards inside of the deadlines can result in an amount of $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not incorporated in an updated, renewed, or revised tenancy agreement, there may be additional penalties or an infringement fee.
Any tenant may request information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the the property manager doesn’t provide the information requested within 21 days of receiving the request, they could receive an infringement letter and be fined as high as $750.
Furthermore, there’s an additional fine of as much as $900 for landlords and property managers who offer a false or false Healthy Homes Statement of Compliance or information. The person who is responsible for this fine is the one who is named on the tenancy contract as the person who is letting the property and it could be the name of the landlord, or the company that manages the property.
The information contained in the Compliance Statement needs to be up-to-date when the tenancy contract is signed, and ideally it is updated through the tenancy period as associated work has been completed.
It is important to remember that landlords who manage multiple rental properties may face more severe penalties for not complying. The highest penalties are reserved for the most serious breaches. Landlords with more than six properties could be fined up to $50,000, and even as high as $100,000 for hearing claims.
