Did you know that the Healthy Homes Standards came into in force on July 1, 2021? Landlords now have to make sure their Twyford rental properties meet the minimum Healthy Homes Standards within 90 days of a renewal or new tenancy and all private rental properties are required to be completely compliant by 1 July 2024.

Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed for a Twyford rental property, all Healthy Homes compliance tasks have to be finished inside of 90 days.

As of 1st July 2021, when a brand new or renewed lease is entered into on a Twyford rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to adhere to any of the Healthy Homes Standards inside of the deadlines can result in penalties of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance is not included within the renewal, new or amended tenancy agreement there could be an additional penalty or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or property manager is unable to provide the information requested within 21 days from having received the inquiry, they will receive an infringement notice and be fined as high as $750.

Additionally, there is also a fine of approximately $900 for landlords and property managers that provide false or misleading Healthy Homes Compliance Statement or other information. The person who is liable for this fine is whoever is named on the tenancy agreement as the person who is letting the property out, so it could be the landlord’s name or the property management company.

All information in the Compliance Statement requirements to be correct before the tenancy agreement can be signed, and ideally it should be maintained throughout the duration of the tenancy when any related work is completed.

It’s important to note that landlords who manage several rental properties can face greater penalties for non-compliance. The most severe penalties are given for the most serious violations, and landlords who own at least six rental properties could be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

When should I require to be in compliance with my Healthy Homes Standards?

Twyford Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is a requirement for all Twyford and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any renewal, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records that prove the conformance to all Healthy Homes Standard that apply or will be applied to an apartment rental.

From July 1st 2021

  • Property managers and private landlords must make sure their rental properties conform in accordance with Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenant.
  • All boarding households (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All homes rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

You don’t need to block up intentional holes or gaps which are part of the building. For example, tiny gaps around doors and windows may be required to allow for movement within the structure as the household gets warmer and cooler, so that they can still be opened and closed rather than sticking. Proper heating is crucial to ensure healthy homes

Heating Twyford

Twyford rental properties need to have a stable heating source that is able to heat the main or largest living space to a minimum of 18degC, even on the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat requirements for it to be permanent (i.e. not portable) and at minimum 1.5 kW in heating capacity, and it must have the minimum requirement for heat capacity for the main living room. For most houses, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are needed. In some instances, like small apartments small apartments, a smaller electric fixed heater may be sufficient.

If the living area already has a central heating source such as heat pumps, it may need a top up to meet the standards. Certain kinds of heaters aren’t able to be used to achieve the standard since they’re either costly, not cost-effective to run, or unsafe to operate.

Ventilation Twyford
