Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed contract is signed on a Te Mata Hills rental property, all Healthy Homes compliance work have to be finished inside of 90 days.

From the 1st of July in 2021, when a new, renewed or varied Tenancy is signed for the Te Mata Hills rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with any of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy contract, there could be additional penalties or an infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or the property manager doesn’t supply the required information within 21 days from getting the notice, the tenant may receive an infringement notice and be fined up to $750.

Additionally, there is also a penalty of as much as $900 for landlords or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person liable to pay this fine is the one who is identified on the tenancy agreement as being the person letting the property out, so it could be the name of the landlord, or the property management company.

The information contained in the Statement of Compliance requirements to be up-to-date before the tenancy agreement can be completed, and should be maintained throughout the tenancy as any related work is completed.

It is crucial to note that a landlord with several rental properties can face more severe penalties for not complying. The highest penalties are handed down for the most serious violations. Those who have at least six rental properties could be penalised up to $50,000, or as high as $100,000 in hearing claims.

When will I need to meet The Healthy Homes Standards?

Te Mata Hills Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory in all Te Mata Hills and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords must keep records that prove conformance with each Healthy Homes Standards that apply or will apply to an apartment rental.

From 1 July 2021

  • Property managers and private landlords have to ensure their rental properties conform with the Healthy Homes Standard within 90 days of any renewal, new or a change in tenancy.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All houses which are rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of when the tenancy first began.

Heating Te Mata Hills

Te Mata Hills rental properties must have a fixed source of heat that can heat the main or largest living space to a minimum of 18degC even on the winter coldest days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating needs for it to be permanent (i.e., not portable) and at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum heating capacity needed to heat the living space in general. The Heating Assessment Tool can be used to determine if the existing fixed heater(s) are sufficient or whether you will need to ‘top up’ with a new heater. Open fires as well as unflued combustion heaters like mobile LPG bottle heaters are not considered acceptable heating options for the Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump then it must be equipped with a thermostat. This will make the heating more uniform and efficient. For most properties, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. In certain situations, like small apartments, a smaller fixed electric heater could be enough.

If your living space already has a central heating source such as an air conditioner, it might require some additional energy to meet the standards. Certain kinds of heaters aren’t able to be used to achieve the standard since they’re either costly, not affordable to run, or are unsafe to operate.
