Fines for Failing to Comply

Anyone can request information about the Healthy Homes Standard and how they relate to the property they live in. If the property manager is unable to provide the required information within 21 days of having received the inquiry, they could receive an infringement letter and be fined up to $750.
In addition, there’s an additional fine of approximately $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or any other information. The person who is responsible to pay this fine is the one who is listed on the tenancy agreement as the one who is leasing the property out It could also be the name of the landlord, or the company that manages the property.
All the information on the Statement of Compliance needs to be current when the tenancy agreement is signed, and ideally it must be updated throughout the duration of the tenancy when any relevant work gets completed.
It is important to note that landlords who manage several rental properties can face more severe penalties for not complying. The most severe penalties are given for the most serious breaches, and landlords with six or more properties could be penalised up to $50,000, and even as high as $100,000 in the case of hearing claims.
