Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed for a Te Mata rental property, all Healthy Homes compliance work have to be done inside of 90 days.

From the 1st of July in 2021, once a new, renewed or varied Tenancy is signed for a Te Mata rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to meet each of Healthy Homes Standards within the deadlines can result in an amount of $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t included in the renewal, new or amended tenancy agreement there may be additional penalties or an infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the building they live in. If the property manager is unable to provide the information requested within 21 days from having received the inquiry, they could be issued an infringement notice and be fined upto $750.

Furthermore, there’s an additional fine of approximately $900 for landlords and property managers providing a false or misleading Healthy Homes Compliance Statement or other information. The person responsible for this fine is the person who is named on the lease agreement as the one who is leasing the property out which could be the name of the landlord, or the property management company.

The information contained in the Statement of Compliance needs to be correct at the time that the tenancy agreement is completed, and should be maintained through the tenancy period as related work is completed.

It is crucial to be aware that a landlord who manage multiple rental properties may receive more severe penalties for not complying. The highest penalties are reserved for serious breaches, and landlords with at least six rental properties could be fined as high as $50,000 and as high as $100,000 in hearing claims.

If you fail to meet your Healthy Homes requirements can hit your wallet and result in significant fines and still having to meet compliance. Do not risk your rental property Contact us now and make arrangements to have a home inspection performed for your rental property.

Unreasonable Gaps & Holes

Draught Stopping Te Mata

Draughts can lead to dropping temperatures within households. A cold house is more expensive to heat, which completed jobs in wasting money and energy.

If a draught is felt through gaps that are too large or holes, it requirements to be sealed.

What are unreasonable gaps or holes?

If you are able to feel external air flowing in or the sound of a clear draught emanating out of a hole or gap, then it is likely a crack or crack that requirements sealing in the way you can. Cracks and gaps that are large should be sealed permanently. Cracks that are greater than 3mm and let air into or out into the home require the sealing. For instance, if an open fireplace isn’t being used, it can cause draughts and should be sealed from. Landlords and property managers are responsible for making sure that such draughts are squelched as far as imaginable.

There is no need to block up intentional gaps or holes which are part of the building. For instance, small gaps around doors and windows could be required to allow for movement within the building when the home warms and cools so that they can still be opened and closed rather than securing. We will test all windows and doors in an Healthy Homes assessment of your rental property.

Adequate heaters are important to ensure healthy homes

Heating Te Mata

Rental properties in Te Mata require a reliable source of heating that can heat the living space to a minimum of 18degC, even on the most coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental well-being.

The source of heating needs to remain fixed (i.e., not portable) with at least 1.5 Kilowatts in heating capacity and have the minimum heating capacity needed for the main living room. A Heating Assessment Tool can be used to determine whether the installed heater(s) are sufficient or if you’ll require to "top up" with an additional heater. Unflued combustion and open fire heaters such as portable LPG bottle heaters aren’t considered acceptable heating options in those following the Healthy Homes Standard.

If the heating system you offer is electric heating or heat pump, it must have an thermostat. This makes the heating more reliable and efficient. For most houses, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are required. In some instances, like apartments with small spaces, a smaller fixed electric heater might be enough.

If the living area already has a permanent heating source like an air conditioner, it might just need an upgrade in order to comply with the standards. Some types of heaters can’t be used to achieve the quality as they are either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Te Mata

Each liveable space in a rental property has to have at least one openable door or window to provide natural ventilation. In addition, humid spaces like kitchens and bathrooms should have an externally vented extractor to get rid of moisture.

The ventilation quality is all about recognising the fact that dry air will be more easy to heat and a property that is well ventilated is less likely to grow damp and mould.

Bedrooms, living rooms, kitchens and dining rooms are considered liveable areas. Spaces that connect, such as the hallway aren’t living spaces and therefore are not need an opening window or door.

Every window, door or the skylight needs at least of opening to the outside, and stay set in an opening position to allow ventilation and fresh air ventilation.

All bathrooms and kitchens and any other area in your property with a bath, shower or cooktop, or any other humidity-generating items will require suitable extractor fans that can be vented to the outside. We offer a Healthy Homes Assessment service will ensure that there is sufficient ventilation in every living space that includes extractor fans that are suitable in areas with high moisture.

Insulation Te Mata

Underfloor and ceiling insulation is mandatory in all rental houses since July 1, 2019. Property managers and landlords are required to ensure that the insulation is in line with the new standard. In some instances, existing ceiling insulation or insulation in the subfloor space may require to be filled with or replaced.

A well-insulated house will reduce the risk of condensation and lessen the likelihood of mould and dampness, and it will make much easier to allow the house to keep the heat.

Insulation requirements to be in compliance with the R-values for your area

The "R" signifies thermal resistance and is a measure of how well the insulation withstands heat flow. The greater the R-value, the more effective the insulation.

  • Zone 1 - Auckland & Northland Ceiling R 2.9, underfloor R 1.3
  • Zone 2 – all of the North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 below floor R 1.3

Te Mata Moisture Ingress & Drainage

Making sure your rental property is protected from the effects of moisture isn’t just a matter of the inside of the building It’s about having to make sure there is somewhere for surface as well as groundwater to move and also stop it from getting inside. When it is about damp and water, it’s often the things you don’t notice that can become a big problem and cause damage to your investment as well as harming the tenant’s health.

Properties that are rented must be equipped with effective drainage to get rid of storm water, surface water and ground water. This includes the proper outfall or runoff. Making sure that water is able to go, and also that it doesn’t get sucked into structures is an important aspect of keeping your property dry.

Alongside an irrigation system to stop moisture from entering, if your property has an enclosed space between your flooring and the ground, a ground moisture barrier should be put in place if it is reasonably practicable to install it.

The ground-moisture barrier typically a sheet of polythene that is placed over the ground to stop any moisture from the ground from entering the building. It also helps prevent water damage to the floor insulation.
