Did you be aware that the Healthy Homes Standards came into effect on the 1st of July 2021? Landlords must make sure their Te Hauke rental properties meet the minimum Healthy Homes Standards within 90 days of a renewed or new tenancy and all private rental properties must be completely in compliance by July 1st 2024.

Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on a Te Hauke rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Beginning on July 1st, 2021, once a new, renewed or varied Tenancy is signed for the Te Hauke rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to meet each of Healthy Homes Standards by the end of the period of time expected can lead to an amount of $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not incorporated in the new, renewed or revised tenancy agreement it could result in an additional fine or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the building they reside in. If the property manager fails to supply the required information within 21 days from getting the notice, the tenant can receive an infringement notification and be fined upto $750.

Additionally, there is also a penalty of approximately $900 for landlords or property managers who offer a false or incorrect Healthy Homes Compliance Statement or other information. The person liable to pay this fine is the one who is named on the lease agreement as the one who is who is letting the property, so it could be the landlord’s name or the property management company.

All the information on the Statement of Compliance needs to be accurate before the tenancy agreement can be executed, and it should be kept updated throughout the tenancy as any related work is completed.

It’s also important to keep in mind that a landlord with several rental properties can face greater penalties for non-compliance. The most severe penalties are handed down for severe breaches. Landlords with at least six rental properties could be penalised up to $50,000, and even as high as $100,000 for hearing claims.

Te Hauke Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement in all Te Hauke and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records to demonstrate compliance with all Healthy Homes Standards that apply or will be in force during the tenancy of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must adhere to the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2023

  • All houses which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Te Hauke

Draughts increase the likelihood of lower temperatures in homes. A cold home will cost more to heat, resulting in wasted money and energy.

If a draught can be felt through gaps that are too large or holes the area needs to be closed.

What are unreasonable gaps or holes?

If you are able to feel external air flowing in or an unobstructed draught coming from a crack or a gap that is, it’s likely to be a gap or hole which requirements sealing in some way. Large cracks and gaps should be permanently stopped. Gaps greater than 3mm that let air into or out of your home need the sealing. For instance, if an open fireplace isn’t used it can create draughts. This should be shut off. Property managers and landlords are accountable for ensuring that these draughts are stopped whenever imaginable.

You don’t need to cover up gaps or holes which are part of the construction. For example, tiny gaps around windows and doors might be necessary to allow for movement of the structure when the household is heated and cools so that they are able to be closed and opened instead of instead of being stuck. Adequate heaters are important for healthy homes

Heating Te Hauke

Rental properties in Te Hauke need to have a stable source of heat that can heat the main or largest living room to at least 18 degrees Celsius, even on the winter coldest days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heating needs that it be permanently fixed (i.e. not portable) with at minimum 1.5 horsepower in capacity, and meet the minimum required heating capacity for the main living room. The Heating Assessment Tool can be used to determine if your current permanent heater(s) are adequate or whether you will need to ‘top up’ by adding a second heater. Unflued combustion and open fire heaters such as mobile LPG bottle heaters aren’t considered to be acceptable heating options under those following the Healthy Homes Standard.

If the heating that you provide is electric heating (or heat pump), it must have the thermostat. This makes the heating more uniform and effective. In most homes, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. However, in certain instances like apartments with small spaces small apartments, a smaller electric fixed heater may suffice.

If the main living room already has a permanent heating source, like an air conditioner, it may require a top up to be able to meet the standards. Some types of heaters can’t be utilised to meet the quality because they’re inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Te Hauke

Insulation Te Hauke

Underfloor and ceiling insulation is required to all rental homes since July 1, 2019. All landlords and property managers have to ensure the insulation meets current standard. In some instances, current ceiling insulation, or the insulation of the sub floor space might require to be replaced or replaced.
