Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed on a Taradale rental property, all Healthy Homes compliance work have to be completed by the end of 90 days.

As of 1st July 2021, once a new, renewed or varied contract is signed on a Taradale rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Inability to adhere to any of the Healthy Homes Standards by the end of the expected timeframe can result in an amount of $7200. In addition, if the existing Healthy Homes Statement of Compliance is not incorporated within an updated, renewed, or revised tenancy agreement there may be an additional fine or infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the property they live in. If the landlord or property manager fails to supply the necessary information within 21 days from being informed of the request, they can receive an infringement letter and be fined up to $750.

In addition, there’s also a penalty of up to $900 for landlords and property managers who have provided a false or false Healthy Homes Statement of Compliance or other information. The person liable to pay this fine is the one who is identified on the tenancy agreement as the one who is who is letting the property, so it could be the name of the landlord, or the property management company.

All the information on the Compliance Statement needs to be current when the tenancy contract is signed, and ideally it should be kept updated during the entire tenancy, as associated work has been completed.

It is also important to remember that a landlord who manage multiple rental properties may face additional fines for non-compliance. The highest penalties are given for severe violations, and landlords who own six or more properties could receive fines of up to $50,000, and as much as $100,000 in hearing claims.

Taradale Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement to all Taradale and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included with any renewed, new or varied tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the compliance with all Healthy Homes Standards that apply or will be applied throughout the tenancy period of their rental properties.

Starting 1 July 2021

  • Private landlords and property managers should make sure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of a new, renewed or varied tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All houses rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Taradale

Draughts may lead to dropping temperatures within households. A draughty house is more expensive to heat, resulting in wasted energy and incurring higher costs.

If a draught is noticed from gaps that are not adequate or holes the area requirements to be sealed.

What are unreasonable gaps or holes?

If you can feel external air getting in, or see an unobstructed draught coming from a crack or a gap, then it is most likely a gap or hole that requirements sealing in some way. Large gaps and cracks should be permanently stopped. The gaps that exceed 3mm that let air into or out within the house require seals. In the case of an open fireplace isn’t used it could cause draughts, and should be sealed from. Property managers and landlords are accountable for ensuring that these draughts are stopped in the maximum extent possible.

There is no require to block off holes or gaps in the building. For instance, small gaps around windows and doors could be required to allow for movement of the structure when the household warms and cools in order to let them be closed and opened rather instead of being stuck. Proper heating is crucial to ensure well-being homes

Heating Taradale

Taradale rental properties need to have a stable heating source that is able to heat the largest or main living space to at least 18degC, even during the winter coldest days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental well-being.

The heating source requirements for it to be permanent (i.e., not portable) and at minimum 1.5 kW in heating capacity and have the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool may be used to determine whether the fix heater(s) are adequate or if you’ll need to "top-up" with a new heater. Fires that are open and unflued heaters such as mobile LPG bottle heaters are not considered to be suitable heating options under those following the Healthy Homes Standard.

If the heating that you offer is electric heating (or heat pump), it requirements to be equipped with the thermostat. This makes the heating more reliable and efficient. For most properties, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters will be required. However, in some cases such as small apartments small apartments, a smaller electric fixed heater may be sufficient.

If the main living room is already equipped with a fixed heating source, such as an air conditioner, it may need an upgrade to meet the standards. Some types of heaters can’t be used to comply with the quality since they’re either not efficient, cost prohibitive to operate and/or unhealthy to run.

Ventilation Taradale

Every living space in a rental property must contain at minimum one open door or window to offer natural ventilation. In addition, high moisture spaces like kitchens and bathrooms should have an venting fan outside to remove moisture.

This ventilation standard is all about recognising how dry air will be easier to heat and that the property that is properly ventilated is less likely to be a victim of mould and damp.

Bedrooms, living rooms dining rooms, and kitchens are considered liveable areas. Connecting spaces like the hallway are not considered liveable and therefore do not need an opening door or window.

Each door, window or the skylight requirements to have the ability to open to the outside, and stay closed, allowing for fresh air circulation and ventilation.

All kitchens and bathrooms, as well as any other space in your property with a bath, shower or cooktop, or any other moisture generating item will need appropriate extractor fans that are vented to the outdoors. Insulation Taradale

The insulation of the ceiling and underfloor is a requirement to all rental houses as of July 1st, 2019. All landlords and property managers should ensure the insulation meets standards that are in line with the latest standard. In certain situations, the existing ceiling insulation or insulation in the subfloor space may need to be filled with or replaced.

A well-insulated property will help to control condensation and lower the chance of dampness and mould, and also makes more easy for the household to retain the heat.
