Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed on a Taradale rental property, all Healthy Homes compliance items must be completed inside of 90 days.

From the 1st of July in 2021, once a new, renewed or varied Tenancy is signed for a Taradale rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to adhere to each of Healthy Homes Standards inside of the expected timeframe can result in penalties of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not included in an updated, renewed, or revised tenancy agreement, there could be an additional penalty or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or property manager does not provide the necessary information within 21 days from having received the inquiry, they will receive an infringement notification and be fined up to $750.

Furthermore, there’s also a fine of approximately $900 for landlords and property managers providing a false or misleading Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the person who is named on the lease agreement as the one who is renting the property which could be the name of the landlord, or the property management company.

All the information on the Compliance Statement requirements to be current before the tenancy agreement can be executed, and it should be kept updated through the tenancy period as necessary work related to it is finished.

It is important to remember that a landlord with multiple rental properties may face more severe penalties for not complying. The harshest penalties are handed down for the most serious violations. Those who have at least six rental properties could be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

Taradale Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is a requirement for all Taradale and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the conformance to the Healthy Homes Standards that apply or will be applied during the tenure of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties conform with the Healthy Homes Standard within 90 days of a new, renewed , or altered tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

From July 1st 2023

  • All houses which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draughts can lead to low temperatures inside homes. A cold house will cost more to heat, which means wasting energy and increased bills.

Proper heating is crucial for well-being houses

Heating Taradale

Taradale rental properties require a reliable source of heating that is able to heat the main or largest living area to at minimum 18 degrees Celsius, even on the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being and mental outlook.

For most houses, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. However, in some cases such as small apartments an electric, fixed heater could be enough.

If the main living room already has a central heating source, like the heat pump, it might just need a top up in order to comply with the standards. Certain types of heaters cannot be used to meet the standard since they’re either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Taradale

Every living space in a rental house must contain at minimum one open windows or an exterior door to offer natural ventilation. Furthermore, moist areas such as kitchens and bathrooms should be equipped with an externally vented extractor fan to eliminate moisture.

Insulation Taradale

Underfloor and ceiling insulation is a requirement to all rental homes from 1 July 2019. All landlords and property managers must ensure that the insulation meets current standard. In some cases, current ceiling insulation, or the insulation of the subfloor space may need to be filled with or replaced.
