Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed contract is signed on a Taradale rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

Beginning on July 1st, 2021, when a brand new or renewed Tenancy is signed for the Taradale rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to meet one of the Healthy Homes Standards within the deadlines can result in a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not incorporated in a new, renewed or revised tenancy agreement, it could result in an additional penalty or infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they are related to the house they reside in. If the property manager does not provide the information requested within 21 days of being informed of the request, they will receive an infringement letter and be fined upto $750.

In addition, there’s also a penalty as much as $900 for property owners or property managers that provide false or misleading Healthy Homes Compliance Statement or information. The person liable for this fine is whoever is listed on the tenancy agreement as the person who is letting the property out and it could be the landlord’s name or the company that manages the property.

All information in the Compliance Statement requirements to be correct before the tenancy agreement can be completed, and should be maintained throughout the tenancy as any associated work has been completed.

It is also important to note that landlords who own multiple rental properties may face even higher fines for non-compliance. The highest penalties are reserved for serious violations, and landlords who own six or more properties could be fined as high as $50,000, and as much as $100,000 in hearing claims.

Tenancies established between 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is required throughout Taradale and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate the conformance to any Healthy Homes Standard that apply or will be in force to your rental home.

Starting 1 July 2021

  • Property managers and private landlords have to make sure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a newly renewed, extended or changed lease.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All homes that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of when the tenancy began.
