Fines for Failing to Comply

As of 1st July 2021, if a new or renewed contract is signed on a Taradale rental property, all Healthy Homes compliance items need to be completed inside of 90 days.

As of 1st July 2021, when a new or renewed lease is entered into on the Taradale rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to adhere to all of the Healthy Homes Standards by the end of the period of time expected can lead to an amount of $7200. Additionally, if the most present Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy agreement there could be additional penalties or an infringement fee.

The person who is responsible to pay this fine is the one who is listed on the tenancy agreement as being the person renting the property, so it could be the landlord’s name or the company that manages the property.

All information in the Statement of Compliance requirements to be correct when the tenancy agreement is signed. It must be updated during the entire tenancy, as relevant work gets completed.

It is crucial to note that landlords with multiple rental properties may receive additional fines for non-compliance. The most severe penalties are handed down for serious violations, and landlords who own more than six properties could be penalised up to $50,000, or as high as $100,000 in the case of hearing claims.

When do I need to be in compliance with The Healthy Homes Standards?

Taradale Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is mandatory for all Taradale and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Landlords and property managers must keep records that prove conformance with the Healthy Homes Standards that apply or will be applicable to an apartment rental.

Beginning 1 July 2021

  • Property managers and private landlords have to ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a new, renewed or varied Tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All houses that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of when the tenancy first began.

Draughts increase the likelihood of less temperature in homes. A draughty home will cost more to heat, resulting in wasted energy and increased bills.

What are unreasonable gaps and holes?

If you can feel external air flowing in or an unobstructed draught coming from a hole or gap that is, it is most likely a gap or an opening that requirements sealing in somehow. Cracks or gaps with large gaps must be permanently stopped. Any gaps greater than 3mm that let air into or out from the home need seals. For example, if the open fireplace isn’t used it can create draughts. This should be sealed off. Landlords and property managers are responsible for ensuring that such draughts are squelched as much as possible.

You don’t require to block off holes or gaps which are part of the construction. For example, tiny gaps around windows and doors could be necessary to allow for movement of the building as the home warms and cools so that they are able to be opened and closed rather than sticking. Adequate heaters are important to ensure well-being homes

Heating Taradale

Rental properties in Taradale should have a permanent source of heat that is able to heat the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source needs to be fixed (i.e., not portable) with at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum heating capacity needed in the living area. In most houses, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are required. In some instances, like apartments with small spaces small apartments, a smaller electric fixed heater may suffice.

If your main living space already has a permanent heating source, like heat pumps, it may require a top up to make sure it meets the requirements. Certain types of heaters cannot be used to comply with the standard since they’re either costly, not affordable to run, and/or unsafe to run.

Ventilation Taradale

In some cases, current ceiling insulation, or the insulation of the sub floor space may require to be filled with or replaced.
