Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed on a Tamatea rental property, all Healthy Homes compliance tasks need to be finished by the end of 90 days.

Beginning on July 1st, 2021, if a new or renewed Tenancy is signed for the Tamatea rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Inability to adhere to each of Healthy Homes Standards by the end of the anticipated timeframe could result in a fine of up to $7200. The person liable for this fine is the one who is listed on the tenancy agreement as the person who is renting the property It could also be the name of the landlord as well as the property management company.

All information in the Statement of Compliance needs to be correct when the tenancy contract is signed, and ideally it should be maintained through the tenancy period as necessary work related to it is finished.

It is also important to remember that landlords who own several rental properties can face additional fines for non-compliance. The most severe penalties are handed down for serious violations. Those who have more than six properties could be penalised up to $50,000, and even as high as $100,000 in the case of hearing claims.

Tamatea Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is mandatory to all Tamatea and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the conformance to all Healthy Homes Standards that apply or will be in force to an apartment rental.

From July 1st 2021

  • Property managers and private landlords have to ensure their rental properties comply in accordance with Healthy Homes Standards within 90 days of a newly renewed, extended or changed Tenancy.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All houses let through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

What are unreasonable gaps or holes?

Cracks or gaps with large gaps must be fixed permanently. The gaps that exceed 3mm that let air in or out from the house require the sealing. Tamatea rental properties need to have a stable heating source which can warm the main or largest living space to a minimum of 18 degrees Celsius, even on the most coldest days of the year. Ceiling and underfloor insulation is required to all rental homes since 1 July 2019. All landlords and property managers must ensure that the insulation is in line with current standard. In certain situations, the existing ceiling insulation or insulation in the subfloor space may need to be topped up or replaced.
