Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed on a Tamatea rental property, all Healthy Homes compliance work have to be finished within 90 days.

Since the 1st July of 2021, if a new or renewed tenancy is signed on a Tamatea rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Inability to adhere to each of Healthy Homes Standards inside of the anticipated timeframe could result in an amount of $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy agreement it could result in an additional fine or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager fails to provide the information requested within 21 days of being informed of the request, they can receive an infringement notification and be fined as high as $750.

In addition, there is an additional fine of approximately $900 for landlords and property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or other information. The person responsible for this fine is whoever is identified on the tenancy agreement as the one who is leasing the property out and it could be the name of the landlord as well as the company that manages the property.

All information in the Statement of Compliance requirements to be current when the tenancy agreement is executed, and it must be updated through the tenancy period as associated work has been completed.

It’s also crucial to remember that a landlord who own multiple rental properties may receive additional fines for non-compliance. The harshest penalties are given for serious violations, and landlords who own at least six rental properties could be fined up to $50,000, and even as high as $100,000 in the case of hearing claims.

Tamatea Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is a requirement in all Tamatea and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or varied tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the compliance with each Healthy Homes Standards that apply or will be in force during the tenure of the rental property.

From 1 July 2021

  • Property managers and private landlords have to ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any newly renewed, extended or changed lease.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2023

  • All households let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Tamatea

Draughts may lead to dropping temperatures within households. A draughty home will cost more to heat, meaning wasting money and energy.

If a draught can be noticed from gaps that are not adequate or holes that it needs to be sealed.

What are the most unreasonable gaps or holes?

If you can feel external air flowing in or the sound of a clear draught emanating from a crack or a gap or crack, then it is likely a crack or hole which requirements sealing in somehow. Large gaps and cracks should be permanently stopped. The gaps that exceed 3mm that let air in or out of the house need to be sealed. For instance, if an open fireplace isn’t in use it could cause draughts, and should be sealed off. Property managers and landlords are accountable for making sure that these draughts are stopped as much as possible.

You don’t need to block off holes or gaps in the construction. For instance, small gaps around windows and doors could be necessary to allow movement of the building when the house gets warmer and cooler, so that they are able to be opened and closed rather instead of being stuck. Heating Tamatea

Tamatea rental properties must have a fixed heating source which can warm the main or largest living room to at least 18degC, even during the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health as well as their mental health.

The heating source needs to be fixed (i.e. not portable), at least 1.5 kW in heating capacity, and must meet the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool may be used to check if the current fix heater(s) are adequate or whether you will need to top up with an additional heater. Unflued combustion and open fire heaters like mobile LPG bottle heaters aren’t considered to be safe heating options under The Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump it should have the thermostat. This makes the heating more consistent and effective. In most houses, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are required. In some instances, such as small apartments small apartments, a smaller electric fixed heater might be enough.

If your living space already has a fixed heating source such as a heat pump, then it could require an upgrade to meet the standards. Certain kinds of heaters aren’t able to be utilised to meet the quality because they’re not effective, cost prohibitive to operate or unsafe to operate.

Ventilation Tamatea

Insulation Tamatea

Ceiling and underfloor insulation has been compulsory in all rental homes since 1 July 2019. Property managers and landlords must ensure that the insulation is up to this new quality. In certain situations, the existing ceiling insulation or insulation in the subfloor space might need to be filled with or replaced.
