Fines for Failing to Comply
Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed for a St Leonards rental property, all Healthy Homes compliance work have to be finished by the end of 90 days.
As of 1st July 2021, if a new, renewed or varied Tenancy is signed for a St Leonards rental property, all Healthy Homes compliance work must be completed within 90 days.
Failure to adhere to any of the Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. In addition, if the current Healthy Homes Statement of Compliance is not incorporated in the new, renewed or amended tenancy agreement there could be an additional fine or violation fee.
Anyone can request details regarding the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager is unable to provide the necessary information within 21 days from being informed of the request, they can receive an infringement letter and be fined up to $750.
Additionally, there is also a penalty of as much as $900 for landlords and property managers who provide a false or incorrect Healthy Homes Compliance Statement or any other information. The person liable for this fine is the one who is named on the tenancy agreement as being the person leasing the property out which could be the landlord’s name or the property management company.
All the information on the Statement of Compliance needs to be correct before the tenancy agreement can be executed, and it should be maintained throughout the duration of the tenancy when any relevant work gets completed.
It’s crucial to keep in mind that a landlord who own several rental properties can face greater penalties for non-compliance. The most severe penalties are handed down for severe breaches, and landlords with six or more properties could be fined up to $50,000, and even as high as $100,000 in the case of hearing claims.
