Did you be aware that the Healthy Homes Standards came into in force on July 1, 2021? Landlords now have to ensure their Raureka rental properties meet the minimum Healthy Homes Standards within 90 days of any new or renewed tenancy, and all private rental properties must be fully compliant by 1 July 2024.

Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed contract is signed on a Raureka rental property, all Healthy Homes compliance work have to be done within 90 days.

As of 1st July 2021, when a brand new, renewed or varied contract is signed on the Raureka rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet all of the Healthy Homes Standards within the deadlines can result in an amount of $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t included within the new, renewed or revised tenancy agreement, it could result in an additional fine or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the home they reside in. If the property manager fails to provide the required information within 21 days of having received the inquiry, they can receive an infringement notice and be fined up to $750.

In addition, there’s also a fine of as much as $900 for landlords and property managers that provide false or incorrect Healthy Homes Statement of Compliance or other information. The person liable to pay this fine is the one who is listed on the tenancy contract as the person who is letting the property It could also be the landlord’s name or the property management company.

The information contained in the Compliance Statement needs to be correct when the tenancy contract is completed, and must be updated throughout the tenancy as any associated work has been completed.

It is also crucial to be aware that landlords who have multiple rental properties could face more severe penalties for not complying. The highest penalties are given for severe violations. Those who have at least six rental properties could receive fines of up to $50,000, and as much as $100,000 in hearings.

Raureka Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is a requirement in all Raureka and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords are required to keep records of their conformance with the Healthy Homes Standard that apply or will be applicable during the tenure of an apartment rental.

From July 1st 2021

  • Private landlords and property managers must make sure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of any renewal, new or a change in tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must adhere to the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Raureka

Draughts may lead to lower temperatures in homes. A humid house costs more to heat, resulting in wasted energy and increased bills.

If a draught could be felt through gaps that are too large or holes, it needs to be closed.

What are unjustifiable gaps or holes?

If you are able to feel external air getting in, or see the sound of a clear draught emanating from a hole or gap or crack, then it’s most likely a gap or crack that needs sealing in somehow. Large cracks and gaps should be permanently stopped. Gaps greater than 3mm that let air in or out within the home need sealing. For example, if an open fireplace isn’t in use it may cause draughts and should be blocked off. Landlords and property managers are accountable for ensuring that these draughts are stopped in the maximum extent imaginable.

You don’t require to block off holes or gaps that are part of the construction. For example, tiny gaps around doors and windows may be required to allow for movement of the structure when the home is heated and cools to allow them to be closed and opened instead of instead of being stuck. Adequate heaters are important to ensure well-being homes

Heating Raureka

Raureka rental properties require a reliable source of heating that can heat the main or largest living area to at minimum 18degC even on the winter coldest days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source requirements to be fixed (i.e. not portable) with at minimum 1.5 kW of heating capacity, and it must have the minimum capacity for heating required to heat the living space in general. The Heating Assessment Tool can be used to determine if your current fix heater(s) are sufficient or if you’ll require to "top up" by adding a second heater. Fires that are open and unflued heaters such as mobile LPG bottle heaters aren’t considered to be suitable heating options in the Healthy Homes Standard.

If the heating you provide is electric heating or heat source, it should include the thermostat. This makes the heating more consistent and efficient. For most homes, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in certain instances such as small apartments the smaller fixed electric heater might be enough.

If the main living room already has a permanent heating source, like heat pumps, it might just require some additional energy to be able to meet the standards. Certain kinds of heaters aren’t able to be utilised to meet the standard since they’re either costly, not affordable to run, or are unsafe to operate.

Insulation Raureka

Underfloor and ceiling insulation is mandatory to all rental houses from 1 July 2019. All landlords and property managers should make sure that the insulation is in line with standards that are in line with the latest quality. In certain situations, the existing ceiling insulation or insulation in the sub floor space may require to be topped up or replaced.
