Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied contract is signed on a Raupunga rental property, all Healthy Homes compliance tasks need to be finished within 90 days.

Since the 1st July of 2021, if a new or renewed Tenancy is signed for the Raupunga rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Inability to adhere to any of the Healthy Homes Standards by the end of the expected timeframe can result in an amount of $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy agreement, it could result in an additional fine or violation fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager is unable to supply the necessary information within 21 days of receiving the request, they could receive an infringement notification and be fined upto $750.

Additionally, there is an additional fine of as much as $900 for landlords and property managers providing a false or inaccurate Healthy Homes Compliance Statement or information. The person responsible for this fine is the person who is listed on the tenancy agreement as the one who is leasing the property out, so it could be the name of the landlord as well as the property management company.

All information in the Compliance Statement requirements to be correct before the tenancy agreement can be completed, and should be maintained throughout the duration of the tenancy when any associated work has been completed.

It’s also important to remember that landlords with multiple rental properties may receive more severe penalties for not complying. The harshest penalties are handed down only for serious violations. Those who have more than six properties could be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

Raupunga Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory to all Raupunga and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records of their the compliance with each Healthy Homes Standard that apply or will be in force to the rental property.

From July 1st 2021

  • Property managers and private landlords are required to ensure their rental properties conform according to Healthy Homes Standards within 90 days of a renewal, new or a change in tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From July 1st 2023

  • All homes let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Raupunga rental properties require a reliable source of heating that can heat the largest or main living space to a minimum of 18degC even on the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating needs that it be permanently fixed (i.e., not portable) that is, at least 1.5 Kilowatts in heating capacity, and it must have the minimum capacity for heating required for the main living space.
