Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed contract is signed on a Putorino rental property, all Healthy Homes compliance tasks must be done inside of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed on the Putorino rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to meet any of the Healthy Homes Standards by the end of the anticipated timeframe could result in penalties of up to $7200. Any tenant may request information regarding the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager is unable to supply the necessary information within 21 days of having received the inquiry, they will receive an infringement letter and be fined as high as $750.

In addition, there is an additional fine of up to $900 for property owners or property managers providing a false or misleading Healthy Homes Statement of Compliance or any other information. The person liable to pay this fine is the one who is listed on the tenancy contract as the person who is letting the property It could also be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement needs to be accurate at the time that the tenancy agreement is signed. It should be maintained through the tenancy period as associated work has been completed.

It is crucial to note that landlords who own multiple rental properties may receive additional fines for non-compliance. The harshest penalties are handed down for serious violations, and landlords who own six or more properties can be fined up to $50,000, and even as high as $100,000 for hearing claims.

If a draft can be felt through gaps that are too large or holes that it requirements to be closed.

What are unreasonable gaps and holes?

If you are able to feel external air entering or the air is clear from a crack or a gap and you are able to feel it, it is most likely a gap or hole that requirements sealing in the way you can. Cracks or gaps with large gaps must be sealed permanently. Any gaps greater than 3mm that let air in or out of your home need sealing. For example, if an open fireplace is not in use, it can create draughts. This should be blocked from. Landlords and property managers are responsible for making sure that draughts from the fireplace are removed whenever imaginable.

You don’t require to block up intentional gaps or holes in the construction. For example, tiny gaps around doors and windows could be required to allow for movement of the structure when the home is heated and cools in order to let them be closed and opened instead of than being stuck. Heating Putorino

The heating source requirements for it to be permanent (i.e. not portable), at minimum 1.5 horsepower in capacity, and meet the minimum requirement for heat capacity to heat the living space in general. The Heating Assessment Tool can be used to check if the existing permanent heater(s) are sufficient or if you’ll need to "top up" with a new heater. Open fires and unflued combustion heaters such as mobile LPG bottle heaters aren’t considered to be safe heating options in the Healthy Homes Standard.

In most homes, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are necessary. In some instances, such as small apartments small apartments, a smaller electric fixed heater may suffice.

If your main living space already has a central heating source such as a heat pump, then it could need a top up in order to comply with the standards. Putorino Moisture Ingress & Drainage

The security of your rental home from dampness isn’t just about the inside of the building It’s about having to ensure there is somewhere to allow surface, rain and ground water to go, and to prevent it from getting into the building. When it is damp and moisture, it’s often not apparent that it could be a huge problem and cause damage to your investment and harming your tenant’s well-being.

Rental properties must have effective drainage for the removal of storm water, surface water, and ground water. This includes an appropriate runoff or outfall. Making sure the water has a proper place to go, and that it doesn’t get sucked into structures is a crucial aspect of making sure your property is dry.

In addition to a drainage system to prevent the ingress of moisture, if your apartment has an enclosed gap between floorboards and the surface, a ground moisture barrier must be installed if it’s reasonably practicable to do so.

An underground moisture barrier generally made of polythene and is laid on top of the ground to stop any moisture present in the ground from getting into the home. It also helps prevent any damage to your underfloor insulation.
