Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed contract is signed on a Putorino rental property, all Healthy Homes compliance items have to be finished by the end of 90 days.

The most severe penalties are handed down only for serious violations, and landlords who own at least six rental properties could be fined up to $50,000 and as high as $100,000 in the case of hearing claims.

Putorino Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is required for all Putorino and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords have to keep records of their conformance with any Healthy Homes Standards that apply or will apply to the rental property.

From July 1st 2021

  • Property managers and private landlords must ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Putorino rental properties require a reliable source of heating that can heat the principal or the biggest living room to at least 18 degrees Celsius, even on the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.
