Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed on a Putorino rental property, all Healthy Homes compliance items must be done inside of 90 days.

It is also important to be aware that landlords who have multiple rental properties could face even higher fines for non-compliance. The harshest penalties are reserved for serious breaches, and landlords with six or more properties can be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

Tenancies established from 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is compulsory in all Putorino and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords must keep records that prove conformance with the Healthy Homes Standards that apply or will be in force to your rental home.

Starting 1 July 2021

  • Property managers and private landlords must make sure their rental properties conform according to Healthy Homes Standards within 90 days of any new, renewed or varied tenant.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All households let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Putorino

Putorino rental properties require a reliable heating source which can warm the principal or the biggest living room to at least 18degC, even on the coldest winter days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental well-being.

The heating source needs to remain fixed (i.e., not portable), at minimum 1.5 kW in heating capacity and have the minimum capacity for heating required for the main living space. If the heating system you provide is an electric heater (or heat pump), then it must have a thermostat. This will make your heating more consistent and effective. For most properties, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in some cases like apartments with small spaces an electric, fixed heater may be sufficient.

If your living space already has a permanent heating source like the heat pump, it might require an update to be able to meet the standards. Some types of heaters can’t be used to meet the standard because they’re not effective, cost prohibitive to operate and/or unsafe to run.
