Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed tenancy is signed on a Pukahu rental property, all Healthy Homes compliance work need to be done by the end of 90 days.

From the 1st of July in 2021, if a new or renewed tenancy is signed on a Pukahu rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to comply with any of the Healthy Homes Standards within the deadlines can result in an amount of $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or amended tenancy agreement it could result in an additional fine or violation fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the property they live in. If the landlord or property manager does not provide the information requested within 21 days from receiving the request, they can receive an infringement notification and be fined as high as $750.

Additionally, there is also a fine of up to $900 for landlords or property managers that provide false or inaccurate Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is whoever is named on the tenancy agreement as the person who is leasing the property out which could be the name of the landlord as well as the company that manages the property.

The information contained in the Compliance Statement requirements to be current at the time that the tenancy agreement is completed, and should be maintained during the entire tenancy, as associated work has been completed.

Pukahu Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is mandatory for all Pukahu and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords are required to keep records to demonstrate the conformance to all Healthy Homes Standard that apply or will be applied during the tenancy of the rental property.

Starting 1 July 2021

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Pukahu rental properties require a reliable source of heating which can warm the living space to a minimum of 18degC even on the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating needs to remain fixed (i.e. not portable), at least 1.5 horsepower in capacity, and must meet the minimum heating capacity needed in the living area. A Heating Assessment Tool may be used to determine if the existing fix heater(s) are adequate or if you’ll need to "top-up" by adding a second heater. If the heating you offer is electric heating or heat source, then it must include an thermostat. This makes the heating more uniform and efficient. For most houses, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are needed. In some instances, like apartments with small spaces the smaller fixed electric heater may be sufficient.
