Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied contract is signed on a Pukahu rental property, all Healthy Homes compliance items must be completed inside of 90 days.

Since the 1st July of 2021, when a new or renewed contract is signed on a Pukahu rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with any of the Healthy Homes Standards within the deadlines can result in a fine of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included in a new, renewed or revised tenancy agreement, there could be additional penalties or an infringement fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or property manager is unable to provide the required information within 21 days of being informed of the request, they may receive an infringement notification and could be fined up to $750.

In addition, there is also a penalty as much as $900 for property owners or property managers that provide false or misleading Healthy Homes Statement of Compliance or information. The person who is responsible to pay this fine is the one who is listed on the tenancy agreement as the one who is renting the property, so it could be the name of the landlord or the company that manages the property.

Pukahu Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is compulsory in all Pukahu and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records that demonstrate compliance with the Healthy Homes Standards that apply or will be applied during the tenure of their rental properties.

Starting 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties comply in accordance with Healthy Homes Standards within 90 days of any new, renewed , or altered tenancy.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must adhere to the Healthy Homes Standard regardless of the time the tenancy began.

  • All houses which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of when the tenancy began.
