Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed for a Poraiti rental property, all Healthy Homes compliance items need to be completed inside of 90 days.

Poraiti Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory for all Poraiti and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records of their the conformance to the Healthy Homes Standards that apply or will be in force throughout the tenancy period of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers have to make sure their rental properties comply to the Healthy Homes Standard within 90 days of any new, renewed , or altered tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All households rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Poraiti rental properties require a reliable source of heating that can heat the largest or main living space to a minimum of 18 degrees Celsius, even on the coldest winter days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.
