Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed for a Poraiti rental property, all Healthy Homes compliance work have to be done inside of 90 days.

As of 1st July 2021, once a new or renewed tenancy is signed on the Poraiti rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to adhere to any of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if a present Healthy Homes Statement of Compliance is not incorporated within a new, renewed or revised tenancy contract, it could result in an additional fine or violation fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager is unable to supply the information requested within 21 days from being informed of the request, they will be issued an infringement notice and be fined as high as $750.

In addition, there is also a fine of as much as $900 for property owners or property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the person who is named on the tenancy agreement as the person who is who is letting the property It could also be the name of the landlord or the property management company.

All the information on the Compliance Statement needs to be up-to-date when the tenancy agreement is signed. It should be maintained throughout the tenancy as any associated work has been completed.

It’s important to remember that a landlord with multiple rental properties may face greater penalties for non-compliance. The highest penalties are given for serious violations, and landlords who own six or more properties could be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

Poraiti Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and 30 June 2021

  • Underfloor and ceiling insulation is required in all Poraiti and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records that prove the compliance with any Healthy Homes Standard that apply or will be applied throughout the tenancy period of an apartment rental.

Starting 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a newly renewed, extended or changed lease.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All houses let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draughts increase the likelihood of low temperatures inside houses. A draughty house costs more to heat, which means wasting money and energy.

Heating Poraiti

Poraiti rental properties need to have a stable source of heating that can heat the main or largest living room to at least 18degC even on the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source needs that it be permanently fixed (i.e., not portable), at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum capacity for heating required for the main living room. The Heating Assessment Tool can be used to determine if the existing fixed heater(s) are sufficient or if you’ll need to "top-up" with an additional heater. Open fires and unflued combustion heaters, such as portable LPG bottle heaters aren’t considered to be safe heating options under those following the Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump, then it must have the thermostat. This makes the heating more uniform and effective. For most properties, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are required. In certain situations, like apartments with small spaces an electric, fixed heater may be sufficient.

If your main living space already has a fixed heating source like the heat pump, it could need a top up to meet the standards. Certain kinds of heaters aren’t able to be used to comply with the quality because they’re not effective, cost prohibitive to operate and/or unhealthy to run.

Ventilation Poraiti

Every living space in the rental property should contain at minimum one open door or window to provide natural ventilation. Additionally, areas with high moisture areas such as kitchens or bathrooms must have a suitable externally vented extractor fan to get rid of moisture.

In some cases, an existing insulation on the ceiling or in the sub floor space might need to be filled with or replaced.
