Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed contract is signed on a Poraiti rental property, all Healthy Homes compliance items have to be done inside of 90 days.

Since the 1st July of 2021, when a new or renewed Tenancy is signed for the Poraiti rental property, all Healthy Homes compliance work must be finished inside of 90 days.

All information in the Statement of Compliance needs to be correct when the tenancy agreement is signed. It should be kept updated through the tenancy period as associated work has been completed.

It’s also important to note that landlords who own multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are reserved for the most serious violations, and landlords who own six or more properties can be penalised up to $50,000 and as high as $100,000 in hearings.

Poraiti Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is required to all Poraiti and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records of their the compliance with all Healthy Homes Standard that apply or will be in force during the tenure of your rental home.

From July 1st 2021

  • Private landlords and property managers should ensure their rental properties comply in accordance with Healthy Homes Standards within 90 days of any new, renewed or varied tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

Beginning 1 July 2023

  • All homes which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Heating Poraiti

Rental properties in Poraiti need to have a stable source of heat that is able to heat the main or largest living room to at least 18degC, even during the coldest winter days.
