Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed contract is signed on a Pirimai rental property, all Healthy Homes compliance tasks must be done by the end of 90 days.

From the 1st of July in 2021, once a new, renewed or varied Tenancy is signed for a Pirimai rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with each of Healthy Homes Standards within the deadlines can result in penalties of up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance is not incorporated within an updated, renewed, or amended tenancy agreement there could be an additional fine or violation fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the property manager is unable to supply the necessary information within 21 days of receiving the request, they may receive an infringement notification and be fined as high as $750.

In addition, there’s also a penalty approximately $900 for landlords and property managers who have provided a false or false Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is the person who is identified on the tenancy agreement as the one who is renting the property which could be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance requirements to be accurate at the time that the tenancy agreement is signed. It should be maintained during the entire tenancy, as associated work has been completed.

It’s crucial to remember that a landlord with multiple rental properties could face additional fines for non-compliance. The most severe penalties are given only for serious breaches, and landlords with more than six properties could receive fines of up to $50,000, or as high as $100,000 in hearing claims.

Pirimai Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is compulsory throughout Pirimai and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any renewal, new or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate conformance with each Healthy Homes Standards that apply or will be applicable during the tenancy of their rental properties.

From 1 July 2021

  • Private landlords and property managers must make sure their rental properties comply according to Healthy Homes Standard within 90 days of a new, renewed or varied Tenancy.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.

Draughts are a major cause of lower temperatures in households. A damp home is more expensive to heat, resulting in wasted energy and increased bills.

What are the most unreasonable gaps or holes?

If you are able to feel external air entering or the sound of a clear draught emanating from a hole or gap or crack, then it is likely to be a gap or hole that needs sealing in the way you can. Cracks and gaps that are large should be stopped permanently. The gaps that exceed 3mm that allow air to enter or exit within your home need sealing. For example, if the open fireplace isn’t being used, it could cause draughts, and should be blocked off. Property managers and landlords are accountable for ensuring that such draughts are squelched in the maximum extent imaginable.

You don’t need to cover up gaps or holes in the construction. For example, tiny gaps around doors and windows may be required to allow movement of the building as the household gets warmer and cooler, so that they are able to be opened and closed rather instead of being stuck. Heating Pirimai

Rental properties in Pirimai should have a permanent heating source that can heat the largest or main living room to at least 18degC, even during the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heating requirements that it be permanently fixed (i.e. not portable) with at least 1.5 kW in heating capacity, and must meet the minimum requirement for heat capacity for the main living room. Open fires and unflued combustion heaters such as small portable LPG bottle heaters are not considered to be acceptable heating options for those following the Healthy Homes Standard.

If the heating you provide is electric heating or heat pump it needs to be equipped with an thermostat. This will make your heating more consistent and effective. For most properties, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are required. However, in some cases such as small apartments the smaller fixed electric heater could be enough.

If the living area already has a fixed heating source, such as heat pumps, it might need an update to meet the standards. Certain kinds of heaters cannot be used to meet the quality as they are either inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Pirimai
