Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed on a Parkvale rental property, all Healthy Homes compliance work have to be done within 90 days.

Since the 1st July of 2021, if a new or renewed Tenancy is signed for a Parkvale rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet each of Healthy Homes Standards within the anticipated timeframe could result in a fine of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t included within the renewal, new or amended tenancy agreement there could be an additional fine or violation fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they are living in. If the property manager is unable to provide the necessary information within 21 days of receiving the request, they could receive an infringement letter and could be fined up to $750.

In addition, there is an additional fine of as much as $900 for landlords and property managers who provide a false or misleading Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is the person who is identified on the tenancy agreement as being the person renting the property which could be the name of the landlord, or the company that manages the property.

The information contained in the Statement of Compliance needs to be correct before the tenancy agreement can be signed. It must be updated throughout the duration of the tenancy when any related work is completed.

It’s important to be aware that landlords who manage multiple rental properties may face additional fines for non-compliance. The harshest penalties are reserved for the most serious breaches. Landlords with six or more properties could be fined up to $50,000 and as high as $100,000 in hearings.

Parkvale Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement throughout Parkvale and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records that demonstrate conformance with the Healthy Homes Standard that apply or will be applicable during the tenancy of their rental properties.

From 1 July 2021

  • Property managers and private landlords must make sure their rental properties conform to the Healthy Homes Standards within 90 days of any new, renewed or varied Tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All houses let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Parkvale

Rental properties in Parkvale need to have a stable source of heating that can warm the living area to at minimum 18 degrees Celsius, even on the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source needs for it to be permanent (i.e., not portable) with at minimum 1.5 kW of heating capacity, and it must have the minimum heating capacity needed for the main living space. For most properties, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters will be required. However, in some cases like small apartments the smaller fixed electric heater might be enough.

If the living area is already equipped with a fixed heating source like the heat pump, it could require a top up to meet the standards. Some types of heaters can’t be utilised to meet the quality because they’re not efficient, cost prohibitive to operate and/or unsafe to run.
