Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed on a Pakowhai rental property, all Healthy Homes compliance tasks have to be completed inside of 90 days.

From the 1st of July in 2021, when a new or renewed contract is signed on a Pakowhai rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to comply with each of Healthy Homes Standards inside of the expected timeframe can result in penalties of up to $7200. When do I require to be in compliance with The Healthy Homes Standards?

Pakowhai Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is a requirement in all Pakowhai and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate conformance with any Healthy Homes Standard that apply or will be applied to the rental property.

Starting 1 July 2021

  • Private landlords and property managers must ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of any renewal, new or a change in tenant.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All houses let through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draughts are a major cause of lower temperatures in houses. A draughty home costs more to heat, meaning wasting energy and resulting in higher bills.

If a draft can be perceived as a result of gaps or holes, it requirements to be sealed.

What are the most unreasonable gaps or holes?

If you are able to feel external air getting in, or see the air is clear from a gap or hole that is, it is likely to be a gap or hole that needs sealing in any way. Large cracks and gaps should be sealed permanently. Any gaps greater than 3mm that allow air in or out from the house require sealing. For example, if the open fireplace isn’t in use it could cause draughts, and should be shut from. Property managers and landlords are responsible for ensuring that these draughts are stopped whenever imaginable.

You don’t require to cover up gaps or holes that are part of the construction. For instance, small gaps around windows and doors could be necessary to allow for the movement of the structure when the house gets warmer and cooler, so that they are able to be shut and opened, rather than sticking. Adequate heaters are crucial for healthy homes

Heating Pakowhai

Pakowhai rental properties should have a permanent heating source that can warm the largest or main living area to at minimum 18degC even on the most coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating needs for it to be permanent (i.e. not portable) that is, at minimum 1.5 horsepower in capacity, and it must have the minimum capacity for heating required to heat the living space in general. The Heating Assessment Tool can be used to check if your current installed heater(s) are sufficient or whether you will need to top up with a new heater. Fires that are open and unflued heaters, such as portable LPG bottle heaters are not considered to be suitable heating options for The Healthy Homes Standard.

If the heating that you offer is an electric heater or heat pump, it must have the thermostat. This will make the heating more consistent and effective. For the majority of houses, bigger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are required. In certain situations, like apartments with small spaces an electric, fixed heater could be enough.

If the living area already has a fixed heating source like an air conditioner, it might just need an upgrade to meet the standards. Certain kinds of heaters cannot be used to achieve the standard since they’re either expensive, inefficient or unsafe to operate.

Ventilation Pakowhai
