Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed for a Napier South rental property, all Healthy Homes compliance items need to be finished within 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on a Napier South rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with each of Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. All the information on the Compliance Statement needs to be current when the tenancy agreement is completed, and is updated during the entire tenancy, as associated work has been completed.

It is also important to be aware that landlords who manage multiple rental properties may face even higher fines for non-compliance. The harshest penalties are reserved for serious violations, and landlords who own more than six properties could be fined as high as $50,000 and as high as $100,000 for hearing claims.

Tenancies commenced from 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement in all Napier South and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords have to keep records that demonstrate the compliance with the Healthy Homes Standards that apply or will be applicable during the tenure of the rental property.

From July 1st 2021

  • Property managers and private landlords must ensure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of a new, renewed , or altered lease.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All households rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of when the tenancy first began.

Heating Napier South

Rental properties in Napier South must have a fixed source of heat that is able to heat the largest or main living area to at minimum 18 degrees Celsius, even on the winter coldest days. In some instances, such as small apartments the smaller fixed electric heater could be enough.
