Fines for Failing to Comply
As of 1st July 2021, when a new or renewed tenancy is signed for a Napier South rental property, all Healthy Homes compliance items need to be done by the end of 90 days.
Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on the Napier South rental property, all Healthy Homes compliance work must be completed by the end of 90 days.
Failure to adhere to one of the Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy agreement, there may be an additional fine or infringement fee.
Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the building they reside in. If the property manager fails to provide the information requested within 21 days of receiving the request, they could receive an infringement notification and be fined as high as $750.
In addition, there is an additional fine of approximately $900 for property owners or property managers who have provided a false or false Healthy Homes Statement of Compliance or information. The person who is liable for this fine is the person who is named on the lease contract as the person who is letting the property which could be the name of the landlord as well as the company that manages the property.
The information contained in the Statement of Compliance requirements to be accurate at the time that the tenancy agreement is signed. It must be updated throughout the duration of the tenancy when any associated work has been completed.
It’s crucial to be aware that a landlord who manage multiple rental properties may face greater penalties for non-compliance. The highest penalties are handed down for serious breaches, and landlords with six or more properties could be fined up to $50,000 and as high as $100,000 for hearing claims.
