Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied contract is signed on a Meeanee rental property, all Healthy Homes compliance tasks must be completed within 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied Tenancy is signed for the Meeanee rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to adhere to all of the Healthy Homes Standards within the expected timeframe can result in an amount of $7200. Additionally, if the most current Healthy Homes Statement of Compliance is not incorporated in an updated, renewed, or revised tenancy contract, there could be an additional penalty or infringement fee.

Anyone can request details regarding the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager does not provide the information requested within 21 days of getting the notice, the tenant may be issued an infringement notice and be fined as high as $750.

In addition, there’s also a fine of up to $900 for landlords and property managers who offer a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the one who is named on the tenancy agreement as the person who is renting the property, so it could be the landlord’s name or the property management company.

The information contained in the Statement of Compliance requirements to be current at the time that the tenancy agreement is executed, and it should be maintained throughout the tenancy as any associated work has been completed.

It’s also important to be aware that landlords with multiple rental properties may face more severe penalties for not complying. The highest penalties are given for severe breaches, and landlords with six or more properties can be fined as high as $50,000 and as high as $100,000 in hearings.

Meeanee Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory in all Meeanee and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords are required to keep records to demonstrate the conformance to any Healthy Homes Standards that apply or will be in force during the tenure of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords must ensure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of any renewal, new or a change in Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All houses let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draughts are a major cause of dropping temperatures within homes. A damp house costs more to heat, resulting in wasted energy and incurring higher costs.

If a draught could be felt from unreasonable gaps or holes, it requirements to be sealed.

What are the most unreasonable gaps or holes?

If you are able to feel external air flowing in or a clear draught from a crack or a gap or crack, then it’s probably a gap or crack that needs sealing in the way you can. Large cracks and gaps should be sealed permanently. Gaps greater than 3mm that allow air to enter or exit of your house require seals. In the case of an open fireplace isn’t being used, it could cause draughts, and must be sealed from. Property managers and landlords are responsible for making sure that these draughts are stopped as much as possible.

You don’t need to block up intentional holes or gaps that are part of the construction. For example, tiny gaps around windows and doors could be required to allow for movement within the structure when the home is heated and cools so that they can still be closed and opened instead of than sticking. Proper heating is crucial for well-being homes

Heating Meeanee

Meeanee rental properties must have a fixed source of heating that can warm the largest or main living area to at minimum 18 degrees Celsius, even on the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating needs that it be permanently fixed (i.e. not portable), at least 1.5 horsepower in capacity, and must meet the minimum required heating capacity for the main living space. A Heating Assessment Tool may be used to determine if the existing installed heater(s) are adequate or whether you will need to "top up" by adding a second heater. Unflued combustion and open fire heaters such as small portable LPG bottle heaters are not considered to be suitable heating options in those following the Healthy Homes Standard.

If the heating system you offer is an electric heater or heat pump it should have a thermostat. This makes the heating more reliable and effective. For the majority of homes, bigger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in some cases such as small apartments the smaller fixed electric heater could be enough.

If your living space already has a fixed heating source, such as heat pumps, it could require a top up to meet the standards. Certain kinds of heaters aren’t able to be used to comply with the standard because they’re not effective, cost prohibitive to operate or unsafe to operate.

Ventilation Meeanee

Every living space in the rental property should have at least one opening door or window to offer natural airflow. Additionally, areas with high moisture spaces like kitchens and bathrooms must have a suitable externally vented extractor fan that can take moisture away.

A ventilation quality is all about acknowledging the fact that the dry atmosphere is easier to heat and heat, and the property that is properly ventilated is less likely to develop damp and mould.

Bedrooms, living rooms, kitchens, and dining areas are considered liveable areas. Connecting spaces such as the hallway aren’t liveable and therefore are not need an opening window or door.

Every window, door or Skylight needs at least to open to the outside and remain set in an opening position, allowing the circulation of fresh air and air flow.

All bathrooms and kitchens and every other room of your house that houses shower, bath or cooktop, or any other humidity-generating items will require adequate extractor fans that vent to the outside. Insulation Meeanee

Ceiling and underfloor insulation is required on all rental homes since July 1, 2019. Property managers and landlords have to make sure that the insulation meets standards that are in line with the latest standard. In some instances, an existing insulation on the ceiling or in the sub floor space may need to be filled with or replaced.

A well-insulated house can help control condensation and lessen the likelihood of mould and dampness as well as making it easier for the house to hold the heat.

Insulation needs to be in compliance with the R-values that are appropriate for your region.

The "R" stands for thermal resistance and is a measure of how well insulation is able to resist heat flow. The more R-value is higher, the more effective the insulation.
