Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied contract is signed on a Meeanee rental property, all Healthy Homes compliance items have to be finished inside of 90 days.

Since the 1st July of 2021, when a brand new or renewed lease is entered into on the Meeanee rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to adhere to each of Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not included in a new, renewed or revised tenancy contract, there may be an additional penalty or infringement fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they are related to the house they live in. If the the property manager doesn’t supply the information requested within 21 days from getting the notice, the tenant may receive an infringement notification and be fined as high as $750.

In addition, there is an additional fine of approximately $900 for landlords or property managers who provide a false or false Healthy Homes Statement of Compliance or other information. The person who is liable for this fine is the one who is identified on the tenancy contract as the person leasing the property out and it could be the name of the landlord, or the property management company.

All the information on the Compliance Statement needs to be accurate when the tenancy contract is signed, and ideally it is updated during the entire tenancy, as associated work has been completed.

It’s important to remember that landlords who own multiple rental properties could face more severe penalties for not complying. The highest penalties are handed down for the most serious violations. Those who have more than six properties could be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.

Tenancies commenced beginning on 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory for all Meeanee and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included with any renewed, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records that prove the conformance to any Healthy Homes Standards that apply or will be applied during the tenancy of your rental home.

From July 1st 2021

  • All rental houses must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Unflued combustion and open fire heaters like the portable LPG bottle heaters aren’t considered to be safe heating options under the Healthy Homes Standard.

If the heating system you offer is an electric heater or heat source, then it must be equipped with the thermostat. This will help make the heating more consistent and effective. For the majority of houses, bigger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are needed. In some instances, such as small apartments, a smaller fixed electric heater could be enough.

If the main living room already has a fixed heating source, like a heat pump, then it may need an upgrade in order to comply with the standards. Some types of heaters can’t be utilised to meet the quality since they’re either inefficient, unaffordable to operate and/or unsafe to run.
