Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed contract is signed on a Meeanee rental property, all Healthy Homes compliance work must be completed within 90 days.

As of 1st July 2021, if a new, renewed or varied lease is entered into on the Meeanee rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to meet one of the Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t included in a new, renewed or revised tenancy agreement there could be an additional penalty or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or the property manager doesn’t provide the required information within 21 days of receiving the request, they can receive an infringement notice and be fined up to $750.

Additionally, there is also a penalty as much as $900 for landlords or property managers that provide false or false Healthy Homes Compliance Statement or any other information. The person who is responsible to pay this fine is the one who is identified on the tenancy agreement as being the person who is letting the property and it could be the name of the landlord as well as the company that manages the property.

The information contained in the Compliance Statement needs to be up-to-date before the tenancy agreement can be completed, and should be maintained throughout the tenancy as any related work is completed.

It is also important to note that a landlord who have multiple rental properties may face even higher fines for non-compliance. The most severe penalties are given for serious breaches, and landlords with more than six properties could be penalised up to $50,000 and as high as $100,000 in hearing claims.

When do I require to be in compliance with my Healthy Homes Standards?

Meeanee Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is required to all Meeanee and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the compliance with the Healthy Homes Standards that apply or will apply to the rental property.

From July 1st 2021

  • Property managers and private landlords are required to ensure their rental properties comply with the Healthy Homes Standards within 90 days of a newly renewed, extended or changed Tenancy.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All homes which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Heating Meeanee

Meeanee rental properties must have a fixed heating source that can heat the main or largest living room to at least 18degC even on the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source needs to be fixed (i.e. not portable) and at minimum 1.5 horsepower in capacity, and it must have the minimum required heating capacity in the living area. For most properties, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in certain instances like small apartment buildings, a smaller fixed electric heater may be sufficient.

If your main living space already has a fixed heating source like an air conditioner, it might just require an upgrade to meet the standards. Certain types of heaters cannot be used to comply with the quality since they’re either inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Meeanee

Property managers and landlords are required to ensure that the insulation is up to this new quality. In some cases, current ceiling insulation, or the insulation of the sub floor space may require to be added or replaced.
