Did you be aware that the Healthy Homes Standards came into effect on the 1st July 2021? The landlords are now required to make sure their Mayfair rental properties meet the minimum Healthy Homes Standards within 90 days of any renewed or new tenancy and all private rentals are required to be fully certified by 1 July 2024.

Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed for a Mayfair rental property, all Healthy Homes compliance items must be completed by the end of 90 days.

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed on a Mayfair rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Inability to adhere to any of the Healthy Homes Standards inside of the deadlines can result in penalties of up to $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t included within a new, renewed or revised tenancy agreement, it could result in an additional penalty or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they are related to the house they are living in. If the property manager does not provide the information requested within 21 days from receiving the request, they could receive an infringement notice and be fined upto $750.

In addition, there is an additional fine of as much as $900 for landlords and property managers who have provided a false or false Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is the person who is identified on the tenancy contract as the person renting the property and it could be the name of the landlord as well as the property management company.

All the information on the Statement of Compliance needs to be current when the tenancy contract is completed, and should be maintained through the tenancy period as related work is completed.

It’s also important to keep in mind that a landlord who manage multiple rental properties may receive even higher fines for non-compliance. The highest penalties are reserved only for serious violations, and landlords who own more than six properties could be penalised up to $50,000, and even as high as $100,000 in hearings.

Mayfair Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is required to all Mayfair and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the compliance with any Healthy Homes Standard that apply or will apply to your rental home.

Starting 1 July 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any new, renewed , or altered tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must adhere to the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All homes let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.

What are unjustifiable gaps or holes?

If you can feel external air flowing in or the air is clear from a hole or gap, then it is most likely a gap or hole which needs sealing in any way. Cracks and gaps that are large should be sealed permanently. Cracks that are greater than 3mm and let air into or out into your home require to be sealed. Heating Mayfair

Mayfair rental properties require a reliable source of heat that is able to heat the largest or main living space to a minimum of 18degC even on the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental outlook.

The source of heating needs to remain fixed (i.e., not portable), at minimum 1.5 kW in heating capacity and have the minimum capacity for heating required in the living area. A Heating Assessment Tool may be used to determine whether the current permanent heater(s) are sufficient or if you’ll need to "top up" with an additional heater. Unflued combustion and open fire heaters, such as portable LPG bottle heaters aren’t considered to be suitable heating options under the Healthy Homes Standard.

If the heating you offer is electric heating or heat pump, it must be equipped with an thermostat. This will make the heating more uniform and effective. For most homes, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters will be required. However, in certain instances like small apartments small apartments, a smaller electric fixed heater might be enough.

If the living area already has a fixed heating source such as the heat pump, it might require an update to be able to meet the standards. Certain types of heaters cannot be used to comply with the quality as they are either not effective, cost prohibitive to operate or are unsafe to operate.

Insulation Mayfair
