Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on a Mayfair rental property, all Healthy Homes compliance items need to be completed by the end of 90 days.

All the information on the Compliance Statement needs to be current when the tenancy contract is completed, and is updated through the tenancy period as relevant work gets completed.

It is important to be aware that a landlord who manage multiple rental properties may face even higher fines for non-compliance. The most severe penalties are given for severe breaches. Landlords with at least six rental properties could be fined as high as $50,000, and even as high as $100,000 in the case of hearing claims.

Mayfair Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is a requirement for all Mayfair and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any renewed, new or modified tenancy agreement.
