Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed contract is signed on a Mayfair rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Mayfair rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Mayfair Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is required for all Mayfair and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate compliance with the Healthy Homes Standards that apply or will apply throughout the tenancy period of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a new, renewed or varied Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All households which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.
