Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed on a Mayfair rental property, all Healthy Homes compliance work have to be completed by the end of 90 days.

It is also crucial to note that landlords who have multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are given for serious violations. Those who have at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 for hearing claims.

Mayfair Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement to all Mayfair and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the compliance with all Healthy Homes Standards that apply or will be in force during the tenancy of an apartment rental.

From 1 July 2021

  • Private landlords and property managers have to make sure their rental properties comply with the Healthy Homes Standard within 90 days of a renewal, new or a change in tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All homes that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Mayfair

Draughts may lead to less temperature in households. A damp home will cost more to heat, meaning wasting energy and resulting in higher bills.

If you can feel external air flowing in or the air is clear from a hole or gap and you are able to feel it, it is likely a crack or an opening that requirements sealing in somehow. For example, tiny gaps around doors and windows could be necessary to allow for movement of the structure when the house gets warmer and cooler, so that they are able to be closed and opened rather than securing. A good heating system is important to ensure well-being homes

Heating Mayfair

Rental properties in Mayfair need to have a stable source of heating that can heat the main or largest living space to at least 18 degrees Celsius, even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

In some instances, like apartments with small spaces the smaller fixed electric heater may be sufficient.

If your main living space already has a central heating source like an air conditioner, it might just require a top up to meet the standards. Certain types of heaters cannot be used to achieve the quality because they’re costly, not cost-effective to run, and/or unsafe to run.

Ventilation Mayfair

Every living space in a rental property must have at least one openable door or window to offer natural airflow. Additionally, areas with high moisture spaces like kitchens and bathrooms must have a suitable externally vented extractor to get rid of moisture.
