Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Mayfair rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Beginning on July 1st, 2021, when a new or renewed contract is signed on the Mayfair rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to adhere to one of the Healthy Homes Standards by the end of the deadlines can result in an amount of $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or amended tenancy agreement it could result in additional penalties or an infringement fee.

Anyone can request information regarding the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager does not supply the necessary information within 21 days of receiving the request, they can receive an infringement notice and be fined as high as $750.

In addition, there is also a fine of approximately $900 for property owners or property managers that provide false or inaccurate Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is the person who is named on the lease agreement as the person who is who is letting the property, so it could be the name of the landlord as well as the company that manages the property.

All the information on the Compliance Statement needs to be current at the time that the tenancy agreement is signed. It must be updated throughout the duration of the tenancy when any necessary work related to it is finished.

It is also crucial to remember that landlords with several rental properties can face even higher fines for non-compliance. The highest penalties are reserved only for serious breaches, and landlords with at least six rental properties could be fined as high as $50,000 and as high as $100,000 in hearing claims.

In the end, a failure to adhere to your Healthy Homes requirements can hit your wallet hard, resulting in significant fines and having to continue to comply. Do not risk your rental property, contact us today and make arrangements to have an home evaluation performed for your rental property.

Draughts increase the likelihood of low temperatures inside houses. A damp house costs more to heat, resulting in wasted energy and resulting in higher bills.

If a draught is felt through gaps that are too large or holes that it needs to be sealed.

What are unreasonable gaps or holes?

If you are able to feel external air entering or an unobstructed draught coming out of a hole or gap and you can feel it, it’s probably a gap or an opening that requirements sealing in some way. Cracks and gaps that are large should be fixed permanently. The gaps that exceed 3mm that let air into or out of the home require seals. For instance, if an open fireplace is not in use, it can cause draughts and must be sealed from. Property managers and landlords are responsible for making sure that draughts from the fireplace are removed as much as imaginable.

There is no require to block off holes or gaps which are part of the construction. For instance, small gaps around doors and windows might be necessary to allow movement of the structure when the home heats and cools, so that they can still be closed and opened instead of than being stuck. We will inspect the windows and doors as part of our Healthy Homes assessment of your rental property.

Proper heating is important for well-being homes

Heating Mayfair

Rental properties in Mayfair should have a permanent source of heat that is able to heat the largest or main living space to a minimum of 18 degrees Celsius, even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat requirements to be fixed (i.e., not portable) that is, at minimum 1.5 horsepower in capacity, and it must have the minimum heating capacity needed for the main living space. A Heating Assessment Tool may be used to check if the existing fix heater(s) are adequate or whether you will require to top up by adding a second heater. Open fires and unflued combustion heaters such as portable LPG bottle heaters are not considered to be suitable heating options under those following the Healthy Homes Standard.

If the heating you provide is electric heating or heat source, then it must have the thermostat. This will make the heating more consistent and effective. For most houses, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are needed. However, in certain instances like apartments with small spaces, a smaller fixed electric heater may be sufficient.

If your living space already has a fixed heating source such as a heat pump, then it might need an upgrade to be able to meet the standards. Certain kinds of heaters cannot be used to comply with the standard because they’re expensive, inefficient or unsafe to operate.

Mayfair Moisture Ingress & Drainage

The security of your rental home from the effects of moisture isn’t just a matter of the inside of the building but you must make sure there is somewhere for surface and underground water to flow, and stop it from coming into the building. When it concerns damp and moisture it’s usually what you don’t see that can cause a lot of trouble, causing the property to suffer and harming the tenant’s well-being.

Rental properties require to be equipped with effective drainage to remove the stormwater and surface waters and groundwater, with an appropriate outfall or runoff. Making sure the water has a place to go, and it doesn’t get sucked into structures is an important aspect of keeping your property dry.

Alongside the drainage system that will prevent the ingress of moisture, if your property has an enclosed space between your floor and the surface, a ground moisture barrier must be installed if it is reasonably practicable to install it.

Ground moisture barriers are generally an insulating sheet of polythene laid over the ground, to block any moisture that is present in the ground from entering the building. It also assists in preventing any damage to your underfloor insulation.
