Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed on a Mayfair rental property, all Healthy Homes compliance items have to be finished within 90 days.

Mayfair Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is compulsory to all Mayfair and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords have to keep records of their the compliance with each Healthy Homes Standards that apply or will apply during the tenancy of their rental properties.

From 1 July 2021

  • Property managers and private landlords must ensure their rental properties conform according to Healthy Homes Standards within 90 days of a renewal, new or a change in Tenancy.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All houses that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.
