Fines for Failing to Comply
Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on a Marewa rental property, all Healthy Homes compliance items need to be completed within 90 days.
As of 1st July 2021, when a brand new, renewed or varied Tenancy is signed for a Marewa rental property, all Healthy Homes compliance work must be finished by the end of 90 days.
Inability to adhere to each of Healthy Homes Standards by the end of the deadlines can result in an amount of $7200. Additionally, if the most current Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy agreement it could result in an additional penalty or infringement fee.
Any tenant can ask for information about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager fails to supply the required information within 21 days from having received the inquiry, they could receive an infringement notification and could be fined up to $750.
Additionally, there is also a penalty as much as $900 for property owners or property managers that provide false or incorrect Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is whoever is named on the tenancy agreement as the person who is who is letting the property, so it could be the name of the landlord or the property management company.
The information contained in the Statement of Compliance needs to be current at the time that the tenancy agreement is completed, and should be maintained during the entire tenancy, as necessary work related to it’s finished.
It is crucial to be aware that landlords who own multiple rental properties may face more severe penalties for not complying. The harshest penalties are handed down for severe violations. Those who have six or more properties could be fined up to $50,000, and even as high as $100,000 in hearings.
