Fines for Failing to Comply

Since the 1st July of 2021, when a new or renewed tenancy is signed for a Marewa rental property, all Healthy Homes compliance tasks have to be finished by the end of 90 days.

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed on the Marewa rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

It is also important to note that landlords who own multiple rental properties may receive additional fines for non-compliance. The highest penalties are given for serious breaches, and landlords with more than six properties could be fined as high as $50,000 and as high as $100,000 for hearing claims.

Marewa Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is mandatory in all Marewa and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords are required to keep records that demonstrate conformance with all Healthy Homes Standard that apply or will be applied during the tenure of their rental properties.

From July 1st 2021

  • Property managers and private landlords have to ensure their rental properties conform to the Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder home tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All houses rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Heating Marewa

Marewa rental properties require a reliable heating source which can warm the living space to at least 18 degrees Celsius, even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source needs to remain fixed (i.e., not portable) that is, at minimum 1.5 kW in heating capacity, and must meet the minimum capacity for heating required for the main living room. The Heating Assessment Tool can be used to determine if your current fixed heater(s) are adequate or if you’ll need to "top up" by adding a second heater. Unflued combustion and open fire heaters like portable LPG bottle heaters aren’t considered to be suitable heating options in The Healthy Homes Standard.

If the heating system you offer is an electric heater (or heat pump), it must have a thermostat. This makes the heating more consistent and efficient. For most houses, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In some instances, like apartments with small spaces, a smaller fixed electric heater may suffice.

If the main living room already has a central heating source, like the heat pump, it might require a top up to meet the standards. Certain types of heaters cannot be used to comply with the standard because they’re not effective, cost prohibitive to operate and/or unhealthy to run.

Ventilation Marewa
