Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed contract is signed on a Marewa rental property, all Healthy Homes compliance tasks have to be done by the end of 90 days.

As of 1st July 2021, when a brand new, renewed or varied Tenancy is signed for a Marewa rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to meet all of the Healthy Homes Standards by the end of the deadlines can result in the possibility of a fine up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or revised tenancy contract, there may be an additional penalty or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the property they are living in. If the property manager fails to supply the necessary information within 21 days from getting the notice, the tenant may receive an infringement notification and be fined up to $750.

Furthermore, there’s also a penalty of approximately $900 for landlords or property managers who provide a false or incorrect Healthy Homes Statement of Compliance or other information. The person who is liable for this fine is the one who is identified on the tenancy agreement as the person who is leasing the property out and it could be the name of the landlord, or the company that manages the property.

All the information on the Statement of Compliance needs to be current when the tenancy contract is completed, and must be updated through the tenancy period as related work is completed.

It is important to be aware that landlords who own several rental properties can face greater penalties for non-compliance. The harshest penalties are handed down for severe breaches, and landlords with six or more properties could be penalised up to $50,000 and as high as $100,000 for hearing claims.

It is clear that failure to comply with the Healthy Homes requirements can hit your wallet resulting in huge fines, in addition to still having to meet compliance. Do not risk your rental property, contact us today and ask us to conduct an house assessment performed on the rental property you are renting.

Unreasonable Gaps & Holes

Draught Stopping Marewa

Draughts can lead to less temperature in homes. A cold house costs more to heat, which completed jobs in wasting money and energy.

If a draught could be felt through gaps that are too large or holes that it requirements to be closed.

What are unreasonable gaps or holes?

If you are able to feel external air coming in or the sound of a clear draught emanating from a crack or a gap, then it is likely a crack or hole that needs sealing in any way. Cracks or gaps with large gaps must be permanently stopped. Cracks that are greater than 3mm and allow air to enter or exit into your house need seals. In the case of an open fireplace isn’t in use it can cause draughts and should be shut from. Landlords and property managers are responsible for making sure that such draughts are squelched as much as possible.

There is no need to block off holes or gaps that are part of the construction. For example, tiny gaps around doors and windows may be required to allow movement of the building as the house gets warmer and cooler, in order to let them be closed and opened instead of instead of being stuck. We will inspect the windows and doors as part of our Healthy Homes assessment of your rental property.

Adequate heaters are crucial to ensure well-being homes

Heating Marewa

Rental properties in Marewa require a reliable source of heating that can heat the living room to at least 18degC, even on the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental outlook.

The source of heating needs for it to be permanent (i.e. not portable) with at least 1.5 horsepower in capacity, and meet the minimum heating capacity needed in the living area. A Heating Assessment Tool may be used to check if the existing fixed heater(s) are adequate or if you’ll need to top up by adding a second heater. Open fires and unflued combustion heaters, such as portable LPG bottle heaters are not considered to be safe heating options for those following the Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump, it should be equipped with the thermostat. This will make your heating more consistent and effective. In most homes, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in some cases like small apartment buildings small apartments, a smaller electric fixed heater could be enough.

If your main living space is already equipped with a fixed heating source, such as the heat pump, it might require an upgrade in order to comply with the standards. Certain types of heaters cannot be used to comply with the standard since they’re either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Marewa

Each liveable space in a rental property has to have at least one openable windows or an exterior door to offer natural ventilation. Furthermore, moist areas such as kitchens and bathrooms should be equipped with an externally vented extractor fan to get rid of moisture.

A ventilation standard is all about recognising how the dry atmosphere is much easier to heat and that the property that is properly ventilated is less likely to be a victim of damp and mould.

Living rooms, bedrooms, kitchens, and dining rooms are all considered living spaces. Connecting spaces like the hallways are not liveable , and thus don’t require an opening door or window.

Each door, window or the skylight requirements to have the ability to open up to the outside, but remain at an open angle, allowing to circulate fresh air as well as air flow.

All bathrooms and kitchens and any other area in your home with a bath, shower, cooktop or other high moisture generating item will require suitable extractor fans which are vented out to the outside. The Healthy Homes Assessment service will ensure that there is sufficient ventilation in every living space that includes extractor fans that are suitable for areas that are high in moisture.

Insulation Marewa

Underfloor and ceiling insulation has been compulsory in all rental houses since 1 July 2019. All landlords and property managers are required to make sure that the insulation is up to standards that are in line with the latest quality. In certain situations, the old ceiling insulation as well as insulation within the subfloor space might require to be replaced or replaced.

A well-insulated house can help control condensation, and decrease the risk of mould and damp, and also makes much easier for the home to retain heat.

Insulation requirements to be in compliance with the R-values that are appropriate for your region.

The "R" is a symbol for thermal resistance and is a gauge of how well the insulation is able to resist heat flow. The more R-value is higher, the higher the standard of insulation.

  • Zone 1 - Auckland & Northland - ceiling R 2.9, underfloor R 1.3
  • Zone 2 – the rest part of North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3, underfloor R 1.3

Marewa Moisture Ingress & Drainage

Protecting your rental property from the effects of moisture isn’t just a matter of the interior of the building but you must ensure there is somewhere for surface or ground water, and prevent it from getting into the building. When it comes to moisture and damp it’s often what you don’t see that can become a big problem that can cause damage to your investment as well as harming your tenant’s well-being.

Rental properties should be equipped with efficient drainage to remove rainwater, storm water and ground water, including an appropriate runoff or outfall. Making sure that water has a location to go, and that it can’t linger underneath the buildings is a vital aspect of making sure your property is dry.

Alongside a drainage system to prevent moisture ingress, if your apartment has an enclosed gap between your floor and the soil, a ground-water barrier must be installed if it is reasonably practicable to install it.

An underground moisture barrier generally a sheet of polythene that is placed over the ground, in order to block any moisture in the ground from rising into the property. It also helps to prevent moisture damage to the underfloor insulation.
