Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed for a Marewa rental property, all Healthy Homes compliance tasks must be done by the end of 90 days.

Since the 1st July of 2021, if a new, renewed or varied contract is signed on the Marewa rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or amended tenancy agreement there could be an additional fine or violation fee.

When should I need to be in compliance with the Healthy Homes Standards?

Marewa Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory in all Marewa and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate conformance with any Healthy Homes Standard that apply or will be applied during the tenure of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a new, renewed or varied tenant.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

From July 1st 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Marewa

Draughts can lead to dropping temperatures within homes. A cold house is more expensive to heat, meaning wasting energy and increased bills.

If a draught can be felt from unreasonable gaps or holes, it needs to be closed.

What are unreasonable gaps or holes?

If you are able to feel external air flowing in or an unobstructed draught coming from a crack or a gap or crack, then it is likely a crack or hole which needs sealing in some way. Cracks or gaps with large gaps must be permanently stopped. Gaps greater than 3mm that allow air in or out from your house need the sealing. For example, if an open fireplace is not in use, it could cause draughts, and must be sealed from. Property managers and landlords are responsible for making sure that these draughts are stopped as far as imaginable.

You don’t need to block gaps or holes that are part of the building. For example, tiny gaps around windows and doors may be required to allow for movement of the building when the household warms and cools so that they can still be opened and closed rather instead of being stuck. Heating Marewa

Marewa rental properties should have a permanent source of heat that can warm the living room to at least 18 degrees Celsius, even on the most coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental outlook.

The source of heat requirements for it to be permanent (i.e., not portable) and at least 1.5 kW in heating capacity, and must meet the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool may be used to check if the current fixed heater(s) are sufficient or if you’ll need to top up with a new heater. Unflued combustion and open fire heaters, such as portable LPG bottle heaters aren’t considered to be suitable heating options for the Healthy Homes Standard.

If the heating that you provide is electric heating or heat pump, it requirements to be equipped with the thermostat. This will make your heating more consistent and effective. For most properties, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are necessary. However, in some cases like apartments with small spaces an electric, fixed heater might be enough.

If the living area already has a fixed heating source, like an air conditioner, it might just need an upgrade to be able to meet the standards. Some types of heaters can’t be used to comply with the standard because they’re expensive, inefficient or unsafe to operate.

Ventilation Marewa

Ceiling and underfloor insulation has been compulsory in all rental houses since 1 July 2019. All landlords and property managers have to ensure that the insulation is in line with current quality. In some instances, old ceiling insulation as well as insulation within the sub floor space may need to be topped up or replaced.
