Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed for a Marewa rental property, all Healthy Homes compliance work need to be finished by the end of 90 days.

All information in the Compliance Statement needs to be up-to-date when the tenancy contract is signed, and ideally it should be maintained throughout the duration of the tenancy when any related work is completed.

It is important to remember that a landlord with several rental properties can face additional fines for non-compliance. The most severe penalties are reserved for serious breaches. Landlords with more than six properties could be fined as high as $50,000, and as much as $100,000 in hearing claims.

Marewa Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is a requirement to all Marewa and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records that demonstrate the compliance with all Healthy Homes Standards that apply or will apply during the tenure of your rental home.

From July 1st 2021

  • Private landlords and property managers are required to ensure their rental properties comply according to Healthy Homes Standard within 90 days of a new, renewed or varied lease.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must adhere to the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All houses which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Marewa

Draughts increase the likelihood of low temperatures inside houses. A cold home is more expensive to heat, which results in wasting energy and increased bills.

What are unreasonable gaps and holes?

If you can feel external air flowing in or an unobstructed draught coming from a crack or a gap that is, it’s likely to be a gap or crack that needs sealing in some way. For example, if an open fireplace isn’t used it could cause draughts, and must be sealed off. Heating Marewa

Marewa rental properties should have a permanent heating source that can heat the largest or main living space to at least 18degC, even during the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source needs to be fixed (i.e. not portable) with at minimum 1.5 kW in heating capacity, and must meet the minimum requirement for heat capacity in the living area. A Heating Assessment Tool can be used to determine whether the fix heater(s) are adequate or if you’ll require to "top up" with a new heater. Fires that are open and unflued heaters such as mobile LPG bottle heaters are not considered acceptable heating options for The Healthy Homes Standard.

If the heating system you provide is an electric heater or heat source, then it must have a thermostat. This makes your heating more consistent and effective. For the majority of homes, bigger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in certain instances like apartments with small spaces, a smaller fixed electric heater might be enough.

If your living space already has a central heating source, such as heat pumps, it may require some additional energy to meet the standards. Certain kinds of heaters aren’t able to be used to comply with the standard as they are either costly, not cost-effective to run, and/or unhealthy to run.

Ventilation Marewa

Insulation for underfloor and ceilings is mandatory in all rental houses from 1 July 2019. All landlords and property managers must ensure that the insulation is in line with this new quality.
