Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied contract is signed on a Maraenui rental property, all Healthy Homes compliance tasks must be completed within 90 days.

Beginning on July 1st, 2021, when a new or renewed Tenancy is signed for a Maraenui rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards inside of the deadlines can result in a fine of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy contract, it could result in an additional fine or violation fee.

The information contained in the Statement of Compliance needs to be up-to-date before the tenancy agreement can be signed. It must be updated through the tenancy period as related work is completed.

It’s important to keep in mind that a landlord who manage multiple rental properties may face more severe penalties for not complying. The most severe penalties are given for the most serious breaches, and landlords with six or more properties could be fined up to $50,000 and as high as $100,000 for hearing claims.

Maraenui Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is mandatory in all Maraenui and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records of their the compliance with each Healthy Homes Standard that apply or will apply throughout the tenancy period of their rental properties.

From July 1st 2021

  • Private landlords and property managers should make sure their rental properties conform with the Healthy Homes Standard within 90 days of any renewal, new or a change in Tenancy.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must adhere to the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of the date when the tenancy started.

You don’t require to block up intentional holes or gaps which are part of the building. For example, tiny gaps around windows and doors could be necessary to allow for the movement of the building when the household warms and cools so that they can still be shut and opened, rather instead of being stuck. Heating Maraenui

Maraenui rental properties must have a fixed heating source that can heat the principal or the biggest living room to at least 18degC, even during the winter coldest days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat requirements to be fixed (i.e., not portable) and at minimum 1.5 kW of heating capacity, and meet the minimum heating capacity needed for the main living room. For the majority of homes, bigger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are required. In some instances, like apartments with small spaces the smaller fixed electric heater could be enough.

If the main living room is already equipped with a fixed heating source like heat pumps, it could require a top up to make sure it meets the requirements. Some types of heaters can’t be used to achieve the standard because they’re not effective, cost prohibitive to operate and/or unhealthy to run.
