Fines for Failing to Comply
From the 1st of July in 2021, once a new, renewed or varied tenancy is signed for a Mangateretere rental property, all Healthy Homes compliance tasks have to be done within 90 days.
As of 1st July 2021, if a new or renewed tenancy is signed on a Mangateretere rental property, all Healthy Homes compliance work must be finished inside of 90 days.
Inability to adhere to all of the Healthy Homes Standards inside of the anticipated timeframe could result in the possibility of a fine up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not included in an updated, renewed, or revised tenancy agreement, it could result in additional penalties or an infringement fee.
Any tenant may request details regarding the Healthy Homes Standard and how they relate to the home they are living in. If the property manager is unable to provide the necessary information within 21 days from getting the notice, the tenant can be issued an infringement notice and be fined up to $750.
In addition, there’s an additional fine of as much as $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the one who is identified on the tenancy agreement as the one who is who is letting the property and it could be the name of the landlord as well as the property management company.
All information in the Compliance Statement needs to be up-to-date at the time that the tenancy agreement is signed. It should be maintained throughout the tenancy as any necessary work related to it’s finished.
It’s also crucial to note that a landlord with multiple rental properties may face greater penalties for non-compliance. The harshest penalties are reserved for severe breaches, and landlords with more than six properties could be penalised up to $50,000, and even as high as $100,000 in the case of hearing claims.
