Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed for a Mahora rental property, all Healthy Homes compliance tasks have to be taken care of within 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied Tenancy is signed for the Mahora rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with any of the Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. The person who is liable for this fine is the one who is named on the tenancy agreement as being the person letting the property out and it could be the name of the landlord, or the property management company.

All information in the Statement of Compliance needs to be current when the tenancy agreement is executed, and it should be maintained throughout the duration of the tenancy when any relevant work gets completed.

It is important to note that landlords who own multiple rental properties may receive even higher fines for non-compliance. The highest penalties are given only for serious violations, and landlords who own six or more properties can be fined as high as $50,000 and as high as $100,000 for hearing claims.

Mahora Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 June 2021

  • Underfloor and ceiling insulation is required to all Mahora and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords have to keep records of their the conformance to any Healthy Homes Standard that apply or will apply to your rental home.

Starting 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties comply to the Healthy Homes Standards within 90 days of any new, renewed , or altered Tenancy.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must adhere to the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All households rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of when the tenancy began.

What are the most unreasonable gaps or holes?

If you are able to feel external air entering or the air is clear from a gap or hole or crack, then it is likely a crack or hole that needs sealing in somehow. Cracks or gaps with large gaps must be fixed permanently. Any gaps greater than 3mm that allow air in or out of your home require to be sealed. For example, if the open fireplace is not in use, it may cause draughts and should be blocked off. Heating Mahora

Mahora rental properties must have a fixed source of heat which can warm the principal or the biggest living space to at least 18degC, even during the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat needs for it to be permanent (i.e., not portable), at least 1.5 horsepower in capacity, and must meet the minimum required heating capacity in the living area. A Heating Assessment Tool may be used to determine whether the fixed heater(s) are adequate or if you’ll need to "top-up" by adding a second heater. Unflued combustion and open fire heaters such as mobile LPG bottle heaters are not considered acceptable heating options under the Healthy Homes Standard.

If the heating you provide is electric heating or heat source, it must include an thermostat. This will make your heating more consistent and efficient. In most homes, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters will be required. In certain situations, like small apartment buildings small apartments, a smaller electric fixed heater could be enough.

If the living area is already equipped with a fixed heating source, like heat pumps, it could require an update to make sure it meets the requirements. Insulation Mahora

Ceiling and underfloor insulation is mandatory for all rent homes from 1 July 2019. Property managers and landlords are required to make sure that the insulation is in line with this new quality.
