Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied tenancy is signed for a Mahora rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed on the Mahora rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to meet all of the Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not incorporated in an updated, renewed, or revised tenancy agreement there could be additional penalties or an infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they are related to the house they reside in. If the property manager is unable to supply the information requested within 21 days from having received the inquiry, they can be issued an infringement notice and be fined upto $750.

Furthermore, there’s an additional fine of approximately $900 for property owners or property managers who provide a false or misleading Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the person who is named on the lease agreement as the one who is leasing the property out It could also be the name of the landlord as well as the property management company.

All the information on the Statement of Compliance needs to be correct when the tenancy agreement is executed, and it is updated during the entire tenancy, as associated work has been completed.

It is important to note that landlords who have multiple rental properties could face greater penalties for non-compliance. The most severe penalties are reserved for the most serious violations, and landlords who own more than six properties could receive fines of up to $50,000 and as high as $100,000 in hearings.

Mahora Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is required in all Mahora and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records to demonstrate conformance with all Healthy Homes Standards that apply or will apply during the tenancy of your rental home.

From 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties conform according to Healthy Homes Standard within 90 days of a newly renewed, extended or changed lease.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must adhere to the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All houses which are rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Heating Mahora

Mahora rental properties need to have a stable source of heating that can heat the principal or the biggest living space to at least 18degC even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source requirements to remain fixed (i.e., not portable) with at minimum 1.5 kW of heating capacity and have the minimum required heating capacity for the main living room. A Heating Assessment Tool can be used to determine whether the current fixed heater(s) are sufficient or if you’ll need to ‘top up’ with a new heater. Fires that are open and unflued heaters such as portable LPG bottle heaters are not considered to be acceptable heating options for those following the Healthy Homes Standard.

If the heating you provide is an electric heater (or heat pump), then it must be equipped with a thermostat. This makes the heating more reliable and effective. For the majority of houses, bigger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. In certain situations, like apartments with small spaces an electric, fixed heater might be enough.

If your main living space already has a central heating source like an air conditioner, it may need some additional energy to meet the standards. Certain types of heaters cannot be used to meet the quality since they’re either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Mahora

The insulation of the ceiling and underfloor has been compulsory to all rental houses as of July 1st, 2019. All landlords and property managers are required to make sure that the insulation meets standards that are in line with the latest standard. In some instances, current ceiling insulation, or the insulation of the subfloor space may need to be topped up or replaced.
