Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied contract is signed on a Longlands rental property, all Healthy Homes compliance tasks must be finished inside of 90 days.

If the landlord or property manager fails to provide the necessary information within 21 days from having received the inquiry, they can receive an infringement letter and could be fined up to $750.

In addition, there is also a penalty approximately $900 for property owners or property managers providing a false or inaccurate Healthy Homes Statement of Compliance or information. The person who is responsible to pay this fine is the one who is listed on the tenancy agreement as the person who is letting the property out It could also be the landlord’s name or the company that manages the property.

All information in the Compliance Statement requirements to be current when the tenancy contract is signed, and ideally it must be updated throughout the duration of the tenancy when any necessary work related to it is finished.

It’s important to be aware that landlords with multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are reserved for serious breaches. Landlords with more than six properties could receive fines of up to $50,000, and as much as $100,000 in hearings.

Longlands Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is required to all Longlands and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords must keep records to demonstrate compliance with each Healthy Homes Standards that apply or will be applicable to your rental home.

From 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties comply according to Healthy Homes Standards within 90 days of a new, renewed or varied Tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From 1 July 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Longlands

Rental properties in Longlands must have a fixed source of heating which can warm the living area to at minimum 18degC, even during the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating needs to be fixed (i.e., not portable) and at minimum 1.5 kW in heating capacity, and it must have the minimum capacity for heating required to heat the living space in general. Ceiling and underfloor insulation is a requirement in all rental houses as of July 1st, 2019. All landlords and property managers must ensure that the insulation is up to the new quality.
