Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied tenancy is signed on a Longlands rental property, all Healthy Homes compliance tasks have to be done inside of 90 days.

From the 1st of July in 2021, when a brand new or renewed contract is signed on a Longlands rental property, all Healthy Homes compliance work must be done within 90 days.

Longlands Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory for all Longlands and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Landlords and property managers must keep records of their conformance with the Healthy Homes Standards that apply or will be applied to their rental properties.

From July 1st 2021

  • Property managers and private landlords are required to make sure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of any new, renewed or varied tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Draughts are a major cause of dropping temperatures within houses. A draughty home costs more to heat, which means wasting energy and resulting in higher bills.

What are unreasonable gaps or holes?

If you are able to feel external air flowing in or an unobstructed draught coming from a gap or hole or crack, then it is likely a crack or hole that needs sealing in any way. Cracks or gaps with large gaps must be fixed permanently. The gaps that exceed 3mm that allow air in or out into the house need to be sealed. For instance, if an open fireplace isn’t being used, it could cause draughts, and must be sealed from. Property managers and landlords are responsible for making sure such draughts are eliminated as far as possible.

Proper heating is crucial to ensure healthy homes

Heating Longlands

Rental properties in Longlands need to have a stable source of heat that is able to heat the main or largest living space to at least 18degC, even during the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat requirements that it be permanently fixed (i.e. not portable) that is, at minimum 1.5 Kilowatts in heating capacity and have the minimum heating capacity needed for the main living room. A Heating Assessment Tool could be used to check if your current permanent heater(s) are adequate or if you’ll require to "top-up" with an additional heater. Unflued combustion and open fire heaters such as the portable LPG bottle heaters aren’t considered to be acceptable heating options for the Healthy Homes Standard.

If the heating that you offer is electric heating or heat pump it must include a thermostat. This will make the heating more uniform and effective. For most properties, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are necessary. In some instances, like apartments with small spaces the smaller fixed electric heater may suffice.

If your living space already has a permanent heating source, like an air conditioner, it might just require an upgrade in order to comply with the standards. Certain kinds of heaters aren’t able to be used to comply with the standard because they’re costly, not cost-effective to run, or unsafe to operate.

Ventilation Longlands

Insulation Longlands

Ceiling and underfloor insulation is a requirement on all rental homes since 1 July 2019. All landlords and property managers have to make sure the insulation meets this new standard. In some cases, old ceiling insulation as well as insulation within the subfloor space may require to be topped up or replaced.
