Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed for a Lochain rental property, all Healthy Homes compliance work need to be taken care of within 90 days.

As of 1st July 2021, once a new, renewed or varied contract is signed on a Lochain rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Inability to adhere to all of the Healthy Homes Standards within the deadlines can result in an amount of $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement, there could be an additional penalty or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the home they reside in. If the property manager does not supply the necessary information within 21 days from having received the inquiry, they could receive an infringement notification and could be fined up to $750.

In addition, there’s an additional fine of up to $900 for landlords and property managers who offer a false or misleading Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is the person who is listed on the tenancy agreement as the one who is who is letting the property which could be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance requirements to be current when the tenancy agreement is completed, and should be maintained throughout the tenancy as any associated work has been completed.

It’s crucial to keep in mind that landlords with multiple rental properties may face additional fines for non-compliance. The highest penalties are handed down for serious violations. Those who have more than six properties could be fined up to $50,000, or as high as $100,000 in hearing claims.

Lochain Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is mandatory throughout Lochain and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or modified tenancy agreement.
  • Landlords and property managers must keep records that prove conformance with the Healthy Homes Standards that apply or will be applicable to your rental home.

Starting 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of a newly renewed, extended or changed Tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All households which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental houses must comply with the Healthy Homes Standard regardless of when the tenancy began.
