Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed contract is signed on a Lochain rental property, all Healthy Homes compliance tasks need to be done within 90 days.

Since the 1st July of 2021, once a new or renewed Tenancy is signed for the Lochain rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to adhere to one of the Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance is not included within the renewal, new or revised tenancy agreement there may be an additional fine or violation fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they are related to the house they reside in. If the property manager fails to provide the information requested within 21 days from receiving the request, they could be issued an infringement notice and be fined upto $750.

In addition, there’s also a fine of as much as $900 for property owners or property managers providing a false or misleading Healthy Homes Statement of Compliance or other information. The person liable for this fine is whoever is listed on the tenancy agreement as the person who is letting the property out It could also be the name of the landlord as well as the company that manages the property.

All the information on the Statement of Compliance needs to be current when the tenancy agreement is signed. It must be updated throughout the tenancy as any associated work has been completed.

It is also crucial to keep in mind that landlords who manage several rental properties can face additional fines for non-compliance. The harshest penalties are reserved only for serious breaches, and landlords with more than six properties could receive fines of up to $50,000, and as much as $100,000 for hearing claims.

When will I need to be in compliance with requirements of the Healthy Homes Standards?

Lochain Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory throughout Lochain and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate conformance with any Healthy Homes Standard that apply or will be applicable to the rental property.

Starting 1 July 2021

  • Property managers and private landlords should ensure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of any renewal, new or a change in tenant.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All homes rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of when the tenancy first began.

What are the most unreasonable gaps or holes?

If you are able to feel external air getting in, or see the sound of a clear draught emanating from a gap or hole or crack, then it is probably a gap or hole that needs sealing in any way. Cracks and gaps that are large should be sealed permanently. Gaps greater than 3mm that allow air in or out into your house need seals. For example, if an open fireplace isn’t being used, it can cause draughts and must be sealed off. Property managers and landlords are accountable for ensuring that these draughts are stopped as much as imaginable.

There is no require to block up intentional holes or gaps in the building. Heating Lochain

Rental properties in Lochain should have a permanent heating source that can warm the principal or the biggest living space to at least 18degC, even during the coldest winter days. Insulation Lochain

Insulation for underfloor and ceilings has been compulsory to all rental houses since 1 July 2019. Property managers and landlords are required to make sure that the insulation is up to current quality. In some cases, an existing insulation on the ceiling or in the sub floor space may need to be filled with or replaced.
