Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed tenancy is signed on a Kotemaori rental property, all Healthy Homes compliance tasks have to be done inside of 90 days.

The person who is responsible for this fine is the person who is named on the lease contract as the person renting the property It could also be the name of the landlord as well as the company that manages the property.

Kotemaori Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory for all Kotemaori and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records of their compliance with all Healthy Homes Standard that apply or will be applied to their rental properties.

Starting 1 July 2021

  • Private landlords and property managers must make sure their rental properties comply according to Healthy Homes Standard within 90 days of any renewal, new or a change in tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All homes rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of when the tenancy first began.

Draughts are a major cause of less temperature in households. A humid home is more expensive to heat, resulting in wasted energy and incurring higher costs.

What are the most unreasonable gaps or holes?

If you are able to feel external air flowing in or the air is clear from a crack or a gap and you can feel it, it’s likely a crack or an opening that needs sealing in somehow. Cracks and gaps that are large should be sealed permanently. The gaps that exceed 3mm that allow air to enter or exit into your house require the sealing. For example, if an open fireplace isn’t being used, it could cause draughts, and must be sealed from. Landlords and property managers are responsible for making sure that draughts from the fireplace are removed as far as possible.

You don’t require to block off gaps or holes that are part of the construction. For instance, small gaps around windows and doors could be necessary to allow for movement within the structure when the home gets warmer and cooler, in order to let them be closed and opened rather than sticking. Heating Kotemaori

Rental properties in Kotemaori require a reliable heating source which can warm the main or largest living area to at minimum 18degC, even on the most coldest days of the year. All landlords and property managers are required to make sure the insulation meets standards that are in line with the latest standard.
