Fines for Failing to Comply

As of 1st July 2021, when a new or renewed contract is signed on a Kotemaori rental property, all Healthy Homes compliance items must be taken care of by the end of 90 days.

From the 1st of July in 2021, when a new, renewed or varied lease is entered into on a Kotemaori rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to meet any of the Healthy Homes Standards within the deadlines can result in a fine of up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance isn’t included in the renewal, new or revised tenancy agreement there could be an additional penalty or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they are related to the house they live in. If the property manager fails to provide the necessary information within 21 days of being informed of the request, they can be issued an infringement notice and be fined as high as $750.

The person responsible to pay this fine is the one who is named on the lease contract as the person renting the property which could be the name of the landlord, or the property management company.

Kotemaori Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory in all Kotemaori and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or altered tenancy contract.

Unreasonable Gaps & Holes

Rental properties in Kotemaori require a reliable source of heating which can warm the principal or the biggest living space to a minimum of 18degC, even during the most coldest days of the year.
