Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed on a Kotemaori rental property, all Healthy Homes compliance work must be completed inside of 90 days.

As of 1st July 2021, once a new or renewed Tenancy is signed for a Kotemaori rental property, all Healthy Homes compliance work must be completed within 90 days.

Inability to adhere to any of the Healthy Homes Standards by the end of the expected timeframe can result in a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not incorporated in the renewal, new or revised tenancy contract, there could be additional penalties or an infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager fails to supply the necessary information within 21 days from getting the notice, the tenant could receive an infringement notification and be fined up to $750.

Furthermore, there’s also a penalty up to $900 for property owners or property managers who provide a false or false Healthy Homes Compliance Statement or information. The person liable to pay this fine is the one who is identified on the tenancy agreement as the one who is leasing the property out which could be the name of the landlord or the company that manages the property.

All information in the Compliance Statement requirements to be up-to-date when the tenancy agreement is completed, and must be updated throughout the duration of the tenancy when any necessary work related to it’s finished.

It is crucial to be aware that a landlord who have several rental properties can face even higher fines for non-compliance. The harshest penalties are given for the most serious violations. Those who have six or more properties can be penalised up to $50,000, and even as high as $100,000 in hearings.

When will I require to meet The Healthy Homes Standards?

Kotemaori Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement in all Kotemaori and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the compliance with the Healthy Homes Standards that apply or will be in force to an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers must ensure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of any new, renewed or varied Tenancy.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All houses rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of when the tenancy first began.

Draughts are a major cause of low temperatures inside homes. A damp house will cost more to heat, resulting in wasted energy and increased bills.

What are unjustifiable gaps or holes?

If you can feel external air getting in, or see an unobstructed draught coming out of a hole or gap and you can feel it, it’s likely to be a gap or crack that requirements sealing in some way. Large gaps and cracks should be sealed permanently. Any gaps greater than 3mm that let air in or out from the house require sealing. For example, if the open fireplace isn’t being used, it could cause draughts, and should be sealed from. Landlords and property managers are accountable for ensuring that draughts from the fireplace are removed as far as possible.

You don’t need to cover up gaps or holes which are part of the building. For instance, small gaps around windows and doors could be required to allow for movement within the structure when the home gets warmer and cooler, so that they can still be closed and opened instead of than sticking. Heating Kotemaori

Kotemaori rental properties require a reliable source of heat that can warm the principal or the biggest living room to at least 18degC even on the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating requirements for it to be permanent (i.e., not portable) and at minimum 1.5 Kilowatts in heating capacity, and meet the minimum requirement for heat capacity for the main living room. A Heating Assessment Tool could be used to check if the fix heater(s) are sufficient or whether you will need to "top up" by adding a second heater. Unflued combustion and open fire heaters like mobile LPG bottle heaters aren’t considered to be acceptable heating options in the Healthy Homes Standard.

If the heating system you offer is electric heating or heat pump it must include the thermostat. This will make the heating more reliable and efficient. For most houses, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. However, in some cases like small apartment buildings, a smaller fixed electric heater could be enough.

If the main living room already has a central heating source like heat pumps, it could require a top up to ensure it meets the requirements. Certain kinds of heaters cannot be used to comply with the standard since they’re either costly, not cost-effective to run, and/or unsafe to run.

Ventilation Kotemaori

Insulation Kotemaori

Ceiling and underfloor insulation is mandatory for all rent houses from 1 July 2019. All landlords and property managers should make sure that the insulation is up to this new quality. In some cases, current ceiling insulation, or the insulation of the subfloor space may need to be replaced or replaced.
