Did you not know that Healthy Homes Standards came into effect on the 1st of July 2021? Landlords now have to ensure that their Karamu rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy, and all private rental properties must be fully in compliance by July 1st 2024.

Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed for a Karamu rental property, all Healthy Homes compliance tasks have to be finished by the end of 90 days.

As of 1st July 2021, when a brand new or renewed contract is signed on the Karamu rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to adhere to each of Healthy Homes Standards by the end of the deadlines can result in the possibility of a fine up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy contract, there could be an additional fine or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the building they live in. If the property manager does not supply the information requested within 21 days from being informed of the request, they can be issued an infringement notice and be fined upto $750.

In addition, there is also a fine of approximately $900 for landlords or property managers who have provided a false or misleading Healthy Homes Compliance Statement or information. The person responsible for this fine is whoever is listed on the tenancy contract as the person letting the property out It could also be the name of the landlord as well as the property management company.

It’s also crucial to keep in mind that a landlord with several rental properties can face additional fines for non-compliance. Karamu Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is required in all Karamu and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records that demonstrate compliance with any Healthy Homes Standard that apply or will be applicable during the tenancy of their rental properties.

Starting 1 July 2021

  • Private landlords and property managers must ensure their rental properties conform with the Healthy Homes Standards within 90 days of any renewal, new or a change in tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Heating Karamu

Karamu rental properties need to have a stable heating source that is able to heat the principal or the biggest living area to at minimum 18degC even on the coldest winter days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating requirements for it to be permanent (i.e., not portable), at least 1.5 kW in heating capacity, and must meet the minimum heating capacity needed in the living area. If the heating system you provide is an electric heater or heat source, it should have a thermostat. This will make the heating more reliable and efficient. For the majority of houses, bigger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters will be required. In certain situations, like apartments with small spaces an electric, fixed heater may suffice.

If your main living space already has a permanent heating source like the heat pump, it may need an update to be able to meet the standards. Some types of heaters can’t be used to achieve the quality as they are either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Karamu

Insulation Karamu

The insulation of the ceiling and underfloor is required in all rental houses since July 1, 2019. Property managers and landlords are required to make sure the insulation meets current standard.
