Healthy Homes Assessment Services

Did you know that the Healthy Homes Standards came into effective on July 1st, 2021? The landlords are now required to make sure that their Karamu rental properties meet the minimum Healthy Homes Standards within 90 days of any new or renewed tenancy, and all private rentals are required to be fully certified by 1 July 2024.

Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed on a Karamu rental property, all Healthy Homes compliance tasks have to be finished by the end of 90 days.

From the 1st of July in 2021, when a new or renewed Tenancy is signed for the Karamu rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to comply with all of the Healthy Homes Standards within the period of time expected can lead to penalties of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included in the new, renewed or amended tenancy agreement there could be an additional penalty or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager is unable to supply the necessary information within 21 days of being informed of the request, they may receive an infringement notice and be fined as high as $750.

In addition, there is also a fine of as much as $900 for property owners or property managers who provide a false or incorrect Healthy Homes Compliance Statement or information. The person who is liable for this fine is the person who is identified on the tenancy agreement as being the person letting the property out which could be the name of the landlord, or the property management company.

All the information on the Compliance Statement needs to be accurate when the tenancy agreement is executed, and it is updated throughout the tenancy as any relevant work gets completed.

It is also important to keep in mind that landlords with several rental properties can face greater penalties for non-compliance. The highest penalties are given only for serious violations. Those who have six or more properties can be fined as high as $50,000 and as high as $100,000 in the case of hearing claims.

What time will I need to be in compliance with The Healthy Homes Standards?

Karamu Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is required throughout Karamu and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records to demonstrate compliance with each Healthy Homes Standard that apply or will be applicable throughout the tenancy period of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords have to ensure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of a new, renewed , or altered tenant.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draughts can lead to dropping temperatures within houses. A damp home will cost more to heat, meaning wasting energy and incurring higher costs.

If a draught can be noticed from gaps that are not adequate or holes, it needs to be closed.

What are unjustifiable gaps or holes?

If you are able to feel external air coming in or the air is clear from a hole or gap, then it’s probably a gap or an opening that requirements sealing in some way. Large gaps and cracks should be permanently stopped. Cracks that are greater than 3mm and allow air to enter or exit of the home need seals. For instance, if an open fireplace isn’t being used, it could cause draughts, and should be shut from. Property managers and landlords are accountable for making sure such draughts are eliminated as far as possible.

There is no require to block up intentional holes or gaps in the construction. Heating Karamu

Karamu rental properties should have a permanent source of heating that can warm the principal or the biggest living area to at minimum 18degC even on the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating requirements that it be permanently fixed (i.e., not portable), at least 1.5 kW in heating capacity, and meet the minimum heating capacity needed in the living area. The Heating Assessment Tool can be used to determine whether the existing permanent heater(s) are sufficient or whether you will require to ‘top up’ with a new heater. Open fires and unflued combustion heaters like the portable LPG bottle heaters are not considered to be suitable heating options in The Healthy Homes Standard.

If the heating you offer is electric heating or heat source, then it must have the thermostat. This will help make the heating more reliable and efficient. For the majority of houses, bigger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are required. In some instances, like apartments with small spaces small apartments, a smaller electric fixed heater may be sufficient.

If the main living room already has a central heating source, such as the heat pump, it might just need an upgrade to be able to meet the standards. Insulation Karamu

Underfloor and ceiling insulation is required on all rental houses since 1 July 2019. All landlords and property managers are required to make sure that the insulation is up to current quality. In some cases, an existing insulation on the ceiling or in the subfloor space might require to be filled with or replaced.
