Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed for a Karamu rental property, all Healthy Homes compliance tasks have to be done inside of 90 days.

As of 1st July 2021, when a brand new, renewed or varied lease is entered into on the Karamu rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t included within a new, renewed or revised tenancy agreement it could result in an additional fine or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager does not supply the information requested within 21 days of getting the notice, the tenant could receive an infringement letter and be fined as high as $750.

Furthermore, there’s also a penalty as much as $900 for property owners or property managers that provide false or inaccurate Healthy Homes Statement of Compliance or other information. The person who is liable for this fine is the person who is listed on the tenancy agreement as the one who is leasing the property out and it could be the name of the landlord or the property management company.

Karamu Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory for all Karamu and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records to demonstrate the compliance with all Healthy Homes Standard that apply or will be applicable throughout the tenancy period of an apartment rental.

Beginning 1 July 2021

  • Property managers and private landlords should make sure their rental properties conform according to Healthy Homes Standards within 90 days of a newly renewed, extended or changed Tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Draughts increase the likelihood of dropping temperatures within households. A humid house costs more to heat, which means wasting energy and resulting in higher bills.

If a draught is noticed from gaps that are not adequate or holes, it requirements to be closed.

What are unreasonable gaps or holes?

If you are able to feel external air getting in, or see the sound of a clear draught emanating from a gap or hole or crack, then it is likely a crack or crack that requirements sealing in somehow. Cracks or gaps with large gaps must be permanently stopped. Cracks that are greater than 3mm and let air in or out within your house require sealing. For example, if an open fireplace isn’t being used, it may cause draughts and should be shut off. Heating Karamu

Karamu rental properties need to have a stable source of heating that can warm the largest or main living space to a minimum of 18 degrees Celsius, even on the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental well-being.

The source of heat requirements to remain fixed (i.e. not portable) and at least 1.5 kW in heating capacity, and it must have the minimum required heating capacity for the main living space. A Heating Assessment Tool could be used to check if the current installed heater(s) are sufficient or if you’ll need to ‘top up’ with an additional heater. Unflued combustion and open fire heaters, such as mobile LPG bottle heaters are not considered acceptable heating options in those following the Healthy Homes Standard.

If the heating you provide is electric heating or heat pump, it should include a thermostat. This will help make the heating more consistent and effective. For the majority of homes, bigger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. However, in some cases like small apartment buildings, a smaller fixed electric heater may suffice.

If the living area is already equipped with a fixed heating source, like heat pumps, it might require a top up to ensure it meets the requirements. Certain types of heaters cannot be utilised to meet the quality since they’re either expensive, inefficient and/or unsafe to run.

Ventilation Karamu

Insulation Karamu

Insulation for underfloor and ceilings is required for all rent homes since 1 July 2019. Property managers and landlords are required to ensure that the insulation meets standards that are in line with the latest quality. In certain situations, the an existing insulation on the ceiling or in the sub floor space may require to be topped up or replaced.

A properly insulated home will help to control condensation and lower the chance of mould and damp, and will also make an easier task for the household to hold the heat.
