Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed contract is signed on a Karamu rental property, all Healthy Homes compliance items need to be done inside of 90 days.

From the 1st of July in 2021, once a new or renewed tenancy is signed on a Karamu rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to adhere to all of the Healthy Homes Standards by the end of the period of time expected can lead to penalties of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not incorporated within an updated, renewed, or revised tenancy contract, it could result in an additional fine or violation fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the property they live in. If the property manager is unable to provide the necessary information within 21 days from receiving the request, they may receive an infringement notification and be fined up to $750.

Furthermore, there’s also a penalty of up to $900 for property owners or property managers who have provided a false or incorrect Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is the person who is identified on the tenancy agreement as the one who is renting the property and it could be the name of the landlord as well as the company that manages the property.

The information contained in the Compliance Statement needs to be current when the tenancy agreement is completed, and should be maintained throughout the duration of the tenancy when any relevant work gets completed.

It is also important to keep in mind that landlords with multiple rental properties may face greater penalties for non-compliance. The highest penalties are reserved for the most serious breaches, and landlords with six or more properties could be fined up to $50,000, or as high as $100,000 in hearing claims.

What time should I need to meet The Healthy Homes Standards?

Karamu Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is a requirement to all Karamu and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records of their conformance with any Healthy Homes Standards that apply or will be applicable throughout the tenancy period of the rental property.

Starting 1 July 2021

  • Private landlords and property managers must make sure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Draughts are a major cause of dropping temperatures within houses. A damp home will cost more to heat, which completed jobs in wasting energy and increased bills.

What are unjustifiable gaps or holes?

If you are able to feel external air coming in or an unobstructed draught coming out of a hole or gap, then it’s probably a gap or crack that needs sealing in somehow. Large gaps and cracks should be stopped permanently. The gaps that exceed 3mm that allow air to enter or exit from your house require the sealing. For example, if the open fireplace isn’t used it can create draughts. This should be blocked from. Property managers and landlords are responsible for ensuring that such draughts are squelched as much as imaginable.

There is no require to block up intentional gaps or holes which are part of the building. For instance, small gaps around doors and windows could be required to allow for the movement of the structure when the household is heated and cools so that they are able to be shut and opened, rather than being stuck. Heating Karamu

Karamu rental properties should have a permanent source of heat that can heat the{ main or largest|| largest or main| principal or the biggest} living space to a minimum of 18degC, even on the coldest winter days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat requirements to be fixed (i.e. not portable) with at minimum 1.5 horsepower in capacity, and meet the minimum required heating capacity for the main living space. A Heating Assessment Tool can be used to check if your current fixed heater(s) are adequate or whether you will need to "top-up" with an additional heater. Fires that are open and unflued heaters, such as the portable LPG bottle heaters are not considered to be safe heating options in those following the Healthy Homes Standard.

If the heating that you offer is electric heating or heat pump, it must be equipped with a thermostat. This makes the heating more consistent and effective. For most homes, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are required. However, in some cases such as small apartments, a smaller fixed electric heater might be enough.

If the main living room already has a central heating source, such as a heat pump, then it could require an update to be able to meet the standards. Certain kinds of heaters aren’t able to be used to achieve the standard since they’re either expensive, inefficient and/or unhealthy to run.

Ventilation Karamu

All bathrooms and kitchens and any other area in your home that has shower, bath cooker or any other moisture generating item will need adequate extractor fans that are vented towards the outside. Insulation Karamu

Insulation for underfloor and ceilings is a requirement on all rental houses since July 1, 2019. Property managers and landlords have to make sure that the insulation meets this new standard. In some cases, old ceiling insulation as well as insulation within the sub floor space may need to be filled with or replaced.
