Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed on a Karamu rental property, all Healthy Homes compliance work must be completed within 90 days.

Beginning on July 1st, 2021, if a new or renewed contract is signed on the Karamu rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to meet all of the Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy agreement, it could result in additional penalties or an infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the building they are living in. In addition, there is also a penalty of as much as $900 for property owners or property managers who have provided a false or misleading Healthy Homes Statement of Compliance or information. The person responsible for this fine is the one who is named on the lease agreement as the one who is renting the property and it could be the name of the landlord, or the property management company.

All information in the Compliance Statement needs to be correct before the tenancy agreement can be signed. It should be kept updated throughout the tenancy as any relevant work gets completed.

It’s also important to remember that landlords who have multiple rental properties may receive additional fines for non-compliance. The most severe penalties are handed down for serious violations. Those who have at least six rental properties could receive fines of up to $50,000, or as high as $100,000 in hearing claims.

Karamu Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is a requirement to all Karamu and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any renewed, new or varied tenancy agreement.

  • All rentals homes have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.
