Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for a Havelock North Central rental property, all Healthy Homes compliance tasks have to be done inside of 90 days.

Beginning on July 1st, 2021, when a new, renewed or varied contract is signed on a Havelock North Central rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

The person who is responsible for this fine is the person who is listed on the tenancy agreement as being the person letting the property out, so it could be the name of the landlord, or the company that manages the property.

All the information on the Compliance Statement requirements to be up-to-date before the tenancy agreement can be signed, and ideally it must be updated during the entire tenancy, as relevant work gets completed.

It is also important to be aware that a landlord who manage multiple rental properties may receive even higher fines for non-compliance. The harshest penalties are reserved only for serious violations. Those who have at least six rental properties could be fined as high as $50,000, and even as high as $100,000 in hearings.

Tenancies that were signed in the period between July 1st 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is a requirement to all Havelock North Central and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included in any renewal, new or modified tenancy agreement.
