Did you be aware that the Healthy Homes Standards came into effect on the 1st of July 2021? The landlords are now required to ensure their Haumoana rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy, and all private rental properties must be completely conforming by the 1st July 2024.

Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied contract is signed on a Haumoana rental property, all Healthy Homes compliance items need to be finished within 90 days.

As of 1st July 2021, when a brand new or renewed Tenancy is signed for the Haumoana rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to adhere to any of the Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t incorporated within an updated, renewed, or amended tenancy agreement it could result in additional penalties or an infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager does not supply the required information within 21 days of having received the inquiry, they may receive an infringement letter and be fined up to $750.

In addition, there is also a penalty as much as $900 for property owners or property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or information. The person responsible for this fine is whoever is listed on the tenancy agreement as the person who is renting the property It could also be the name of the landlord, or the property management company.

All information in the Compliance Statement requirements to be correct before the tenancy agreement can be executed, and it should be maintained through the tenancy period as relevant work gets completed.

It is important to be aware that a landlord who have multiple rental properties may receive even higher fines for non-compliance. The harshest penalties are reserved for severe breaches, and landlords with six or more properties can be fined up to $50,000 and as high as $100,000 in hearing claims.

Haumoana Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement to all Haumoana and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any renewed, new or varied tenancy agreement.
  • Landlords and property managers must keep records that prove the conformance to each Healthy Homes Standards that apply or will be applicable throughout the tenancy period of the rental property.

Starting 1 July 2021

  • Private landlords and property managers must ensure their rental properties conform to the Healthy Homes Standard within 90 days of a new, renewed or varied tenancy.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Rental properties in Haumoana should have a permanent source of heat that can heat the main or largest living space to a minimum of 18degC even on the coldest days of the year. The source of heating needs to remain fixed (i.e. not portable), at minimum 1.5 kW in heating capacity and have the minimum required heating capacity to heat the living space in general. For the majority of homes, bigger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. If your living space already has a central heating source, such as heat pumps, it could need an update to meet the standards. Some types of heaters can’t be used to meet the quality as they are either costly, not cost-effective to run, or unsafe to operate.
