Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed for a Haumoana rental property, all Healthy Homes compliance items have to be finished by the end of 90 days.

Beginning on July 1st, 2021, once a new or renewed lease is entered into on the Haumoana rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet each of Healthy Homes Standards by the end of the expected timeframe can result in an amount of $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t incorporated within a new, renewed or revised tenancy agreement, it could result in an additional penalty or infringement fee.

Haumoana Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory for all Haumoana and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records that demonstrate conformance with all Healthy Homes Standards that apply or will be applicable to the rental property.

From July 1st 2021

  • Private landlords and property managers must make sure their rental properties comply according to Healthy Homes Standards within 90 days of a new, renewed or varied Tenancy.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All houses let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Draughts can lead to less temperature in households. A humid house will cost more to heat, which means wasting energy and resulting in higher bills.

If a draught is perceived as a result of gaps or holes the area needs to be sealed.

What are unreasonable gaps and holes?

If you can feel external air entering or the sound of a clear draught emanating from a crack or a gap and you can feel it, it is most likely a gap or an opening that requirements sealing in somehow. Cracks or gaps with large gaps must be permanently stopped. The gaps that exceed 3mm that let air into or out into your home need seals. For example, if the open fireplace is not in use, it can create draughts. This must be sealed from. Property managers and landlords are responsible for ensuring that these draughts are stopped as much as imaginable.

There is no need to cover up gaps or holes which are part of the construction. For instance, small gaps around windows and doors may be required to allow for movement of the building when the house heats and cools, so that they can still be closed and opened instead of than securing. Heating Haumoana

Rental properties in Haumoana should have a permanent source of heating that is able to heat the principal or the biggest living space to a minimum of 18degC, even during the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating requirements to be fixed (i.e., not portable) that is, at minimum 1.5 horsepower in capacity, and must meet the minimum required heating capacity to heat the living space in general. If the heating system you offer is electric heating or heat source, then it must include a thermostat. This will help make the heating more uniform and effective. For most homes, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are required. In certain situations, like small apartment buildings small apartments, a smaller electric fixed heater may be sufficient.

If the main living room already has a fixed heating source, like a heat pump, then it could need an update to be able to meet the standards. Certain types of heaters cannot be used to comply with the quality as they are either inefficient, unaffordable to operate or unsafe to operate.

Ventilation Haumoana

Insulation for underfloor and ceilings is required for all rent houses as of July 1st, 2019. Property managers and landlords must ensure that the insulation is in line with current standard. In some instances, existing ceiling insulation or insulation in the sub floor space may require to be topped up or replaced.
