Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed for a Hastings Central rental property, all Healthy Homes compliance tasks must be taken care of inside of 90 days.

As of 1st July 2021, when a new, renewed or varied contract is signed on a Hastings Central rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to meet each of Healthy Homes Standards within the anticipated timeframe could result in a fine of up to $7200. When Do I need to meet The Healthy Homes Standards?

Hastings Central Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 June 2021

  • Underfloor and ceiling insulation is compulsory to all Hastings Central and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records to demonstrate conformance with any Healthy Homes Standards that apply or will apply to the rental property.

From July 1st 2021

  • Property managers and private landlords should ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of any newly renewed, extended or changed lease.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Heating Hastings Central

Rental properties in Hastings Central must have a fixed source of heating that can warm the largest or main living area to at minimum 18degC even on the most coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source needs for it to be permanent (i.e. not portable) and at least 1.5 horsepower in capacity, and meet the minimum heating capacity needed to heat the living space in general. If the heating system you provide is an electric heater or heat pump, then it must include a thermostat. This makes your heating more consistent and efficient. For most properties, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. In certain situations, like small apartments the smaller fixed electric heater could be enough.

If your living space already has a fixed heating source, such as the heat pump, it could require an update to meet the standards. Some types of heaters can’t be used to achieve the standard because they’re expensive, inefficient and/or unsafe to run.

Ventilation Hastings Central

Each living space within a rental property must have at least one opening windows or an exterior door to provide natural airflow. In addition, humid areas such as kitchens and bathrooms should have an externally vented extractor fan that can eliminate moisture.
