Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed for a Hastings Central rental property, all Healthy Homes compliance tasks need to be completed within 90 days.

Since the 1st July of 2021, once a new, renewed or varied contract is signed on the Hastings Central rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to comply with all of the Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy agreement it could result in an additional fine or violation fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager is unable to supply the information requested within 21 days from receiving the request, they will receive an infringement letter and be fined upto $750.

Additionally, there is an additional fine of up to $900 for property owners or property managers providing a false or incorrect Healthy Homes Statement of Compliance or information. The person who is responsible for this fine is whoever is named on the lease agreement as the one who is leasing the property out, so it could be the name of the landlord, or the company that manages the property.

The information contained in the Statement of Compliance needs to be correct at the time that the tenancy agreement is signed. It should be kept updated throughout the tenancy as any necessary work related to it’s finished.

It is also crucial to remember that a landlord who own multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are given for the most serious breaches, and landlords with six or more properties can receive fines of up to $50,000 and as high as $100,000 for hearing claims.

When Do I need to meet requirements of the Healthy Homes Standards?

Hastings Central Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is mandatory throughout Hastings Central and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the compliance with all Healthy Homes Standard that apply or will be in force during the tenancy of your rental home.

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.
