Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied contract is signed on a Frimley rental property, all Healthy Homes compliance work must be done inside of 90 days.

As of 1st July 2021, when a new or renewed lease is entered into on the Frimley rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to meet each of Healthy Homes Standards inside of the anticipated timeframe could result in the possibility of a fine up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or revised tenancy contract, there could be an additional fine or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the home they reside in. If the property manager does not supply the required information within 21 days of receiving the request, they will receive an infringement notification and be fined as high as $750.

In addition, there’s also a penalty approximately $900 for landlords or property managers that provide false or false Healthy Homes Statement of Compliance or information. The person who is responsible to pay this fine is the one who is identified on the tenancy agreement as the person who is letting the property out It could also be the name of the landlord or the company that manages the property.

All information in the Statement of Compliance needs to be accurate at the time that the tenancy agreement is signed, and ideally it should be maintained through the tenancy period as relevant work gets completed.

It’s also crucial to note that a landlord who have multiple rental properties may face more severe penalties for not complying. The highest penalties are reserved for the most serious breaches. Landlords with six or more properties can be fined up to $50,000 and as high as $100,000 in hearing claims.

Frimley Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement for all Frimley and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records that prove the compliance with each Healthy Homes Standard that apply or will be applicable throughout the tenancy period of your rental home.

From July 1st 2021

  • Private landlords and property managers must ensure their rental properties conform according to Healthy Homes Standard within 90 days of a newly renewed, extended or changed lease.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of when the tenancy began.

Heating Frimley

Frimley rental properties must have a fixed heating source that can heat the living area to at minimum 18 degrees Celsius, even on the winter coldest days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source needs for it to be permanent (i.e., not portable) with at minimum 1.5 kW in heating capacity and have the minimum requirement for heat capacity to heat the living space in general. Underfloor and ceiling insulation has been compulsory on all rental houses since July 1, 2019. All landlords and property managers are required to ensure the insulation meets the new standard. In some cases, current ceiling insulation, or the insulation of the sub floor space might require to be replaced or replaced.
