Fines for Failing to Comply

As of 1st July 2021, if a new or renewed tenancy is signed for a Frasertown rental property, all Healthy Homes compliance work need to be finished inside of 90 days.

The person responsible for this fine is the person who is named on the lease agreement as the one who is renting the property which could be the name of the landlord, or the property management company.

The information contained in the Compliance Statement requirements to be current at the time that the tenancy agreement is completed, and is updated during the entire tenancy, as relevant work gets completed.

It’s crucial to note that landlords who manage multiple rental properties could face greater penalties for non-compliance. The harshest penalties are given for severe breaches, and landlords with more than six properties could receive fines of up to $50,000, and as much as $100,000 in hearing claims.

Frasertown Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is mandatory throughout Frasertown and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Landlords and property managers must keep records that demonstrate compliance with each Healthy Homes Standards that apply or will be in force to an apartment rental.

What are unreasonable gaps and holes?

If you are able to feel external air entering or the air is clear from a hole or gap, then it’s most likely a gap or an opening that requirements sealing in somehow. Frasertown rental properties need to have a stable source of heating that can warm the principal or the biggest living room to at least 18degC, even on the coldest winter days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.
