Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed for a Flaxmere rental property, all Healthy Homes compliance items have to be done inside of 90 days.

From the 1st of July in 2021, when a new or renewed contract is signed on a Flaxmere rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to comply with each of Healthy Homes Standards inside of the anticipated timeframe could result in penalties of up to $7200. The person liable for this fine is whoever is listed on the tenancy agreement as the one who is letting the property out and it could be the name of the landlord, or the property management company.

All the information on the Compliance Statement needs to be current when the tenancy contract is completed, and must be updated throughout the duration of the tenancy when any necessary work related to it’s finished.

It is crucial to keep in mind that a landlord with multiple rental properties may receive additional fines for non-compliance. The harshest penalties are handed down only for serious breaches. Landlords with more than six properties could be fined up to $50,000, and even as high as $100,000 for hearing claims.

Flaxmere Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is mandatory for all Flaxmere and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords must keep records to demonstrate compliance with any Healthy Homes Standards that apply or will be applicable during the tenure of their rental properties.

From July 1st 2021

  • Property managers and private landlords should ensure their rental properties comply to the Healthy Homes Standards within 90 days of a renewal, new or a change in Tenancy.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All homes that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Flaxmere

Rental properties in Flaxmere require a reliable source of heating that can heat the main or largest living area to at minimum 18degC, even during the winter coldest days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heating needs that it be permanently fixed (i.e., not portable), at least 1.5 horsepower in capacity and have the minimum heating capacity needed for the main living space. For the majority of houses, bigger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters will be required. In some instances, like apartments with small spaces the smaller fixed electric heater might be enough.

If your main living space already has a fixed heating source such as an air conditioner, it may require an upgrade in order to comply with the standards. Some types of heaters can’t be utilised to meet the standard as they are either costly, not affordable to run, or unsafe to operate.

Ventilation Flaxmere
