Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed on an Eskdale rental property, all Healthy Homes compliance items must be completed by the end of 90 days.

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed on the Eskdale rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the expected timeframe can result in an amount of $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not incorporated in a new, renewed or revised tenancy agreement, there may be additional penalties or an infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the building they are living in. If the property manager is unable to supply the required information within 21 days from having received the inquiry, they will receive an infringement notification and be fined upto $750.

Additionally, there is an additional fine of approximately $900 for landlords or property managers that provide false or misleading Healthy Homes Statement of Compliance or other information. The person who is liable for this fine is the one who is identified on the tenancy contract as the person who is letting the property It could also be the landlord’s name or the property management company.

All information in the Statement of Compliance needs to be up-to-date before the tenancy agreement can be completed, and is updated during the entire tenancy, as associated work has been completed.

It is also important to remember that landlords with several rental properties can face more severe penalties for not complying. The harshest penalties are given for the most serious breaches, and landlords with six or more properties can be fined up to $50,000 and as high as $100,000 in the case of hearing claims.

Eskdale Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is compulsory throughout Eskdale and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records that prove conformance with all Healthy Homes Standards that apply or will be applicable throughout the tenancy period of their rental properties.

From 1 July 2021

  • Property managers and private landlords must ensure their rental properties comply to the Healthy Homes Standards within 90 days of a new, renewed , or altered tenancy.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must adhere to the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All homes rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of when the tenancy first began.

Heating Eskdale

Eskdale rental properties should have a permanent source of heating that can warm the principal or the biggest living space to a minimum of 18degC, even on the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat needs for it to be permanent (i.e. not portable), at least 1.5 kW of heating capacity, and meet the minimum heating capacity needed in the living area. Open fires and unflued combustion heaters, such as portable LPG bottle heaters are not considered acceptable heating options under those following the Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump, it must be equipped with an thermostat. This will make the heating more uniform and effective. For the majority of homes, bigger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. In some instances, such as small apartments, a smaller fixed electric heater could be enough.

If your living space already has a permanent heating source like heat pumps, it may need an upgrade to meet the standards. Certain kinds of heaters cannot be used to meet the standard because they’re not efficient, cost prohibitive to operate or unsafe to operate.

Ventilation Eskdale
