Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for an Eskdale rental property, all Healthy Homes compliance items have to be done inside of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied lease is entered into on an Eskdale rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Inability to adhere to any of the Healthy Homes Standards inside of the deadlines can result in the possibility of a fine up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not included in an updated, renewed, or revised tenancy contract, it could result in an additional fine or violation fee.

It’s crucial to keep in mind that landlords who manage multiple rental properties could face greater penalties for non-compliance. The harshest penalties are handed down only for serious breaches. Landlords with six or more properties can receive fines of up to $50,000, and as much as $100,000 in hearings.

When should I require to be in compliance with The Healthy Homes Standards?

Eskdale Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement to all Eskdale and New Zealand rental homes where it is reasonably practicable to put in.

From 1 July 2021

  • All boarder houses (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.
