Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for a Bridge Pā rental property, all Healthy Homes compliance tasks need to be taken care of within 90 days.

As of 1st July 2021, if a new, renewed or varied Tenancy is signed for the Bridge Pā rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to meet each of Healthy Homes Standards within the deadlines can result in an amount of $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy agreement there may be an additional penalty or infringement fee.

Anyone can request information regarding the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager does not provide the necessary information within 21 days of receiving the request, they can be issued an infringement notice and could be fined up to $750.

In addition, there is also a penalty of up to $900 for landlords or property managers that provide false or misleading Healthy Homes Statement of Compliance or other information. The person responsible for this fine is the one who is named on the tenancy contract as the person letting the property out which could be the name of the landlord or the property management company.

All information in the Statement of Compliance needs to be accurate when the tenancy contract is executed, and it should be kept updated throughout the tenancy as any relevant work gets completed.

It’s also important to be aware that a landlord who have multiple rental properties may face greater penalties for non-compliance. The harshest penalties are handed down for severe breaches. Landlords with at least six rental properties could be penalised up to $50,000, or as high as $100,000 in the case of hearing claims.

Bridge Pā Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory for all Bridge Pā and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records of their conformance with any Healthy Homes Standard that apply or will be in force to an apartment rental.

From 1 July 2021

  • Private landlords and property managers are required to make sure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a new, renewed or varied tenant.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All homes which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Adequate heaters are crucial to ensure well-being houses

Heating Bridge Pā

Bridge Pā rental properties require a reliable heating source that can heat the living space to at least 18degC even on the winter coldest days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The heating source requirements to remain fixed (i.e. not portable) and at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum requirement for heat capacity for the main living room. A Heating Assessment Tool could be used to determine if the existing fix heater(s) are sufficient or whether you will need to "top-up" with a new heater. Open fires and unflued combustion heaters such as small portable LPG bottle heaters aren’t considered to be suitable heating options in The Healthy Homes Standard.

If the heating system you offer is electric heating (or heat pump), it requirements to be equipped with a thermostat. This will make the heating more reliable and effective. For most homes, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters will be required. However, in some cases like apartments with small spaces an electric, fixed heater could be enough.

If the main living room already has a central heating source such as an air conditioner, it may require an upgrade to meet the standards. Certain kinds of heaters cannot be utilised to meet the quality because they’re not efficient, cost prohibitive to operate and/or unsafe to run.

Ventilation Bridge Pā

Every living space of a rental property must have at least one openable doors or windows to offer natural ventilation. In addition, high moisture areas like kitchens and bathrooms need to have an venting fan outside to eliminate moisture.

Insulation Bridge Pā

Insulation for underfloor and ceilings is a requirement in all rental homes as of July 1st, 2019. All landlords and property managers must make sure that the insulation meets standards that are in line with the latest quality. In certain situations, the current ceiling insulation, or the insulation of the sub floor space may need to be replaced or replaced.

A properly insulated home will reduce the risk of condensation, and decrease the risk of mould and dampness and it will make it easier to allow the house to retain the heat.
