Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed for a Bridge Pā rental property, all Healthy Homes compliance tasks must be taken care of inside of 90 days.

As of 1st July 2021, if a new, renewed or varied contract is signed on a Bridge Pā rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Inability to adhere to all of the Healthy Homes Standards within the deadlines can result in a fine of up to $7200. Tenancies signed in the period between July 1st 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory to all Bridge Pā and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records of their conformance with any Healthy Homes Standards that apply or will be applicable during the tenancy of an apartment rental.

From July 1st 2021

  • Property managers and private landlords are required to make sure their rental properties comply to the Healthy Homes Standard within 90 days of any new, renewed or varied Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From 1 July 2023

  • All houses rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

If your main living space already has a permanent heating source like an air conditioner, it may need an update in order to comply with the standards. Certain kinds of heaters cannot be used to meet the quality because they’re inefficient, unaffordable to operate and/or unsafe to run.
