Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed on a Bay View rental property, all Healthy Homes compliance work need to be completed within 90 days.

Failure to comply with one of the Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy contract, there may be additional penalties or an infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or the property manager doesn’t supply the necessary information within 21 days from having received the inquiry, they may receive an infringement notice and be fined up to $750.

Furthermore, there’s also a penalty as much as $900 for landlords and property managers providing a false or inaccurate Healthy Homes Compliance Statement or other information. The person who is liable for this fine is whoever is named on the lease contract as the person leasing the property out, so it could be the name of the landlord or the company that manages the property.

The information contained in the Statement of Compliance requirements to be up-to-date before the tenancy agreement can be completed, and must be updated throughout the tenancy as any relevant work gets completed.

It is also important to note that a landlord who manage multiple rental properties may face more severe penalties for not complying. The highest penalties are given for serious violations, and landlords who own six or more properties can be penalised up to $50,000, and as much as $100,000 in hearing claims.

Bay View Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement in all Bay View and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records that demonstrate compliance with the Healthy Homes Standard that apply or will be in force to an apartment rental.

Beginning 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.
