Fines for Failing to Comply

As of 1st July 2021, when a new or renewed contract is signed on a Bay View rental property, all Healthy Homes compliance tasks need to be completed within 90 days.

Since the 1st July of 2021, when a new, renewed or varied lease is entered into on a Bay View rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to comply with all of the Healthy Homes Standards within the deadlines can result in an amount of $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included within a new, renewed or revised tenancy agreement, it could result in an additional penalty or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager does not supply the necessary information within 21 days from having received the inquiry, they could be issued an infringement notice and could be fined up to $750.

Furthermore, there’s also a penalty up to $900 for property owners or property managers that provide false or incorrect Healthy Homes Compliance Statement or any other information. The person who is liable for this fine is whoever is named on the lease agreement as the person who is who is letting the property, so it could be the name of the landlord or the property management company.

Tenancies that were signed in the period between July 1st 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is compulsory for all Bay View and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords must keep records that demonstrate conformance with any Healthy Homes Standards that apply or will be in force during the tenure of your rental home.

Starting 1 July 2021

Heating Bay View

Rental properties in Bay View should have a permanent source of heating that can heat the principal or the biggest living area to at minimum 18degC, even on the coldest winter days.
