Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed for a Bay View rental property, all Healthy Homes compliance work need to be completed within 90 days.

Beginning on July 1st, 2021, when a new or renewed contract is signed on a Bay View rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to comply with all of the Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance isn’t incorporated within a new, renewed or revised tenancy agreement there may be additional penalties or an infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they are related to the house they live in. If the landlord or the property manager doesn’t provide the required information within 21 days from being informed of the request, they will receive an infringement notice and be fined up to $750.

In addition, there is an additional fine of up to $900 for landlords and property managers who offer a false or misleading Healthy Homes Compliance Statement or information. The person liable for this fine is the person who is named on the tenancy agreement as the one who is who is letting the property, so it could be the name of the landlord, or the company that manages the property.

The information contained in the Compliance Statement requirements to be current when the tenancy contract is completed, and should be kept updated throughout the duration of the tenancy when any relevant work gets completed.

It’s important to remember that a landlord who own multiple rental properties may face more severe penalties for not complying. The highest penalties are handed down only for serious breaches. Landlords with six or more properties could be fined as high as $50,000, or as high as $100,000 in hearings.

Bay View Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement for all Bay View and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included with any renewed, new or amended tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the conformance to each Healthy Homes Standards that apply or will be applicable throughout the tenancy period of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers must ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any new, renewed , or altered Tenancy.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental houses must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Bay View

Rental properties in Bay View require a reliable heating source that can warm the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat needs to remain fixed (i.e., not portable) with at least 1.5 Kilowatts in heating capacity and have the minimum heating capacity needed for the main living space. A Heating Assessment Tool may be used to determine if your current fix heater(s) are adequate or whether you will need to "top-up" by adding a second heater. Open fires and unflued combustion heaters, such as small portable LPG bottle heaters are not considered to be acceptable heating options for those following the Healthy Homes Standard.

If the heating system you offer is an electric heater or heat source, then it must have an thermostat. This will make your heating more consistent and efficient. For most properties, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters will be required. However, in some cases like small apartments, a smaller fixed electric heater may be sufficient.

If your main living space already has a central heating source, such as a heat pump, then it might just require some additional energy to ensure it meets the requirements. Certain kinds of heaters cannot be used to achieve the standard since they’re either inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Bay View

Insulation Bay View

The insulation of the ceiling and underfloor is required in all rental homes from 1 July 2019. All landlords and property managers are required to ensure that the insulation is up to the new standard. In some instances, an existing insulation on the ceiling or in the sub floor space might need to be added or replaced.
