Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed for a Bay View rental property, all Healthy Homes compliance tasks have to be finished within 90 days.

Since the 1st July of 2021, once a new, renewed or varied lease is entered into on the Bay View rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Bay View Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is a requirement for all Bay View and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords must keep records that prove the conformance to any Healthy Homes Standards that apply or will be applied throughout the tenancy period of your rental home.

From 1 July 2021

  • Private landlords and property managers must ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenant.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All homes which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.
