Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed for a Bay View rental property, all Healthy Homes compliance work have to be finished by the end of 90 days.

Since the 1st July of 2021, when a brand new or renewed Tenancy is signed for the Bay View rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to adhere to any of the Healthy Homes Standards within the deadlines can result in an amount of $7200. In addition, if the existing Healthy Homes Statement of Compliance is not included in a new, renewed or amended tenancy agreement there may be an additional penalty or infringement fee.

Anyone can request details about the Healthy Homes Standard and how they relate to the home they are living in. If the property manager fails to supply the information requested within 21 days from receiving the request, they can be issued an infringement notice and be fined up to $750.

Additionally, there is also a penalty up to $900 for landlords or property managers that provide false or misleading Healthy Homes Compliance Statement or other information. The person liable for this fine is the one who is named on the tenancy agreement as being the person leasing the property out and it could be the name of the landlord or the property management company.

It’s crucial to remember that landlords with several rental properties can face additional fines for non-compliance. The harshest penalties are handed down only for serious violations, and landlords who own six or more properties could be fined up to $50,000 and as high as $100,000 in hearings.

Bay View Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement for all Bay View and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any renewed, new or varied tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the compliance with the Healthy Homes Standard that apply or will apply to your rental home.

Beginning 1 July 2021

  • Property managers and private landlords have to make sure their rental properties conform with the Healthy Homes Standard within 90 days of a new, renewed , or altered tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All households rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Bay View

Bay View rental properties should have a permanent source of heating that can warm the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat requirements for it to be permanent (i.e., not portable) and at minimum 1.5 kW in heating capacity, and it must have the minimum capacity for heating required in the living area. Ventilation Bay View
