Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed on an Anderson Park rental property, all Healthy Homes compliance tasks must be completed inside of 90 days.

Beginning on July 1st, 2021, when a new or renewed contract is signed on an Anderson Park rental property, all Healthy Homes compliance work must be finished within 90 days.

The information contained in the Compliance Statement requirements to be correct at the time that the tenancy agreement is completed, and must be updated throughout the tenancy as any relevant work gets completed.

It’s also crucial to remember that a landlord who manage multiple rental properties may face more severe penalties for not complying. The most severe penalties are reserved for severe violations, and landlords who own more than six properties could receive fines of up to $50,000, or as high as $100,000 for hearing claims.

When do I need to meet The Healthy Homes Standards?

Anderson Park Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory throughout Anderson Park and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the conformance to each Healthy Homes Standard that apply or will be applied to your rental home.

Beginning 1 July 2021

  • Private landlords and property managers should make sure their rental properties comply in accordance with Healthy Homes Standards within 90 days of a newly renewed, extended or changed Tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All households that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

There is no need to block up intentional gaps or holes in the building. Heating Anderson Park

Anderson Park rental properties should have a permanent source of heating that is able to heat the principal or the biggest living room to at least 18 degrees Celsius, even on the most coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heating needs for it to be permanent (i.e., not portable) with at minimum 1.5 horsepower in capacity, and meet the minimum required heating capacity to heat the living space in general. For most properties, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in certain instances such as small apartments, a smaller fixed electric heater may suffice.

If the living area already has a permanent heating source, such as the heat pump, it could need an update to make sure it meets the requirements. Some types of heaters can’t be used to meet the quality since they’re either expensive, inefficient and/or unsafe to run.
