Did you know that the Healthy Homes Standards came into in force on July 1, 2021? Landlords now have to ensure their Ahuriri rental properties meet the minimum Healthy Homes Standards within 90 days of any renewal or new tenancy and all private rentals are required to be fully in compliance by July 1st 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied contract is signed on an Ahuriri rental property, all Healthy Homes compliance items have to be completed inside of 90 days.

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on an Ahuriri rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with any of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t included within a new, renewed or revised tenancy agreement, there may be additional penalties or an infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or the property manager doesn’t provide the necessary information within 21 days of being informed of the request, they could receive an infringement letter and be fined as high as $750.

In addition, there is also a fine of approximately $900 for landlords and property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or information. The person who is responsible for this fine is the one who is listed on the tenancy agreement as being the person who is letting the property It could also be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement needs to be correct before the tenancy agreement can be signed. It should be maintained throughout the tenancy as any necessary work related to it’s finished.

It’s crucial to be aware that a landlord who have multiple rental properties may face additional fines for non-compliance. The highest penalties are given only for serious breaches. Landlords with six or more properties can be penalised up to $50,000, and even as high as $100,000 in the case of hearing claims.

Ahuriri Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is required to all Ahuriri and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords must keep records of their compliance with each Healthy Homes Standard that apply or will be in force to an apartment rental.

From 1 July 2021

  • Private landlords and property managers should make sure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All homes that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of when the tenancy first began.

Heating Ahuriri

Ahuriri rental properties require a reliable heating source that is able to heat the principal or the biggest living room to at least 18degC, even during the most coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source needs to remain fixed (i.e., not portable) and at least 1.5 kW in heating capacity and have the minimum capacity for heating required for the main living room. A Heating Assessment Tool could be used to determine if the current installed heater(s) are sufficient or whether you will require to "top-up" with an additional heater. Open fires and unflued combustion heaters like small portable LPG bottle heaters are not considered to be safe heating options for those following the Healthy Homes Standard.

If the heating system you provide is an electric heater or heat pump it needs to be equipped with a thermostat. This makes the heating more consistent and efficient. In most homes, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters will be required. However, in some cases like small apartments the smaller fixed electric heater may suffice.

If your main living space already has a central heating source, like the heat pump, it may require an upgrade in order to comply with the standards. Certain kinds of heaters cannot be used to comply with the standard as they are either inefficient, unaffordable to operate or unsafe to operate.

Ventilation Ahuriri

Each liveable space in the rental property should include at least one open windows or an exterior door to provide natural airflow. In addition, high moisture spaces like kitchens and bathrooms should have an externally vented extractor fan that can eliminate moisture.
