Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed for an Ahuriri rental property, all Healthy Homes compliance tasks must be completed within 90 days.

From the 1st of July in 2021, when a brand new or renewed contract is signed on the Ahuriri rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Inability to adhere to each of Healthy Homes Standards inside of the deadlines can result in an amount of $7200. Additionally, there is also a penalty as much as $900 for landlords or property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or information. The person liable for this fine is the person who is named on the tenancy agreement as the one who is letting the property out and it could be the name of the landlord or the property management company.

Ahuriri Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is compulsory for all Ahuriri and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords must keep records of their conformance with any Healthy Homes Standard that apply or will be applicable during the tenure of the rental property.

From 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties conform to the Healthy Homes Standard within 90 days of any newly renewed, extended or changed lease.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All homes rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of the date when the tenancy started.

There is no need to block gaps or holes which are part of the building. For instance, small gaps around windows and doors might be necessary to allow for movement within the building as the household is heated and cools so that they can still be shut and opened, rather than sticking. Adequate heaters are crucial for healthy houses

Heating Ahuriri

Ahuriri rental properties require a reliable heating source that can heat the largest or main living area to at minimum 18degC even on the winter coldest days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

However, in certain instances like apartments with small spaces an electric, fixed heater may suffice.

If the main living room is already equipped with a fixed heating source, such as an air conditioner, it might need an upgrade in order to comply with the standards. Certain types of heaters cannot be utilised to meet the standard because they’re not effective, cost prohibitive to operate or are unsafe to operate.
