Healthy Homes Assessment Services

Did you not know that Healthy Homes Standards came into effect on the 1st of July 2021? The landlords are now required to make sure that their Ahuriri rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy and all private rental properties are required to be completely conforming by the 1st July 2024.

Failure to fulfill the requirements in the Healthy Homes Standards is a violation in the Residential Tenancies Act 1986, and landlords who are not following the rules could be subject to fines of up to $7200 plus any additional healthy homes related fines.

Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied tenancy is signed on an Ahuriri rental property, all Healthy Homes compliance tasks have to be finished within 90 days.

Beginning on July 1st, 2021, when a brand new or renewed lease is entered into on the Ahuriri rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards within the period of time expected can lead to an amount of $7200. Additionally, if a current Healthy Homes Statement of Compliance is not incorporated in a new, renewed or amended tenancy agreement it could result in additional penalties or an infringement fee.

Anyone can request information about the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager does not provide the information requested within 21 days of being informed of the request, they will receive an infringement notice and be fined upto $750.

In addition, there is also a penalty up to $900 for landlords or property managers who offer a false or false Healthy Homes Compliance Statement or information. The person responsible for this fine is whoever is named on the tenancy agreement as the person who is letting the property out which could be the landlord’s name or the property management company.

All information in the Statement of Compliance requirements to be current when the tenancy contract is executed, and it is updated during the entire tenancy, as related work is completed.

It is important to note that landlords who own several rental properties can face additional fines for non-compliance. The highest penalties are handed down for serious violations, and landlords who own more than six properties could be fined as high as $50,000, and even as high as $100,000 in the case of hearing claims.

Ahuriri Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is compulsory to all Ahuriri and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords have to keep records that demonstrate the conformance to the Healthy Homes Standard that apply or will be applied during the tenure of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers have to ensure their rental properties conform according to Healthy Homes Standards within 90 days of any new, renewed or varied tenant.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All houses let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Ahuriri

Draughts may lead to dropping temperatures within homes. A humid home costs more to heat, which means wasting energy and increased bills.

If a draught is noticed from gaps that are not adequate or holes the area needs to be closed.

What are unjustifiable gaps or holes?

If you can feel external air flowing in or a clear draught from a hole or gap or crack, then it’s likely to be a gap or hole which requirements sealing in somehow. Large gaps and cracks should be permanently stopped. Gaps greater than 3mm that allow air to enter or exit from your house require sealing. In the case of an open fireplace isn’t being used, it may cause draughts and should be sealed off. Landlords and property managers are responsible for making sure such draughts are eliminated in the maximum extent imaginable.

You don’t require to cover up gaps or holes in the construction. For example, tiny gaps around windows and doors could be necessary to allow for movement of the structure as the household warms and cools so that they are able to be shut and opened, rather than sticking. Adequate heaters are important to ensure well-being houses

Heating Ahuriri

Rental properties in Ahuriri must have a fixed heating source that can warm the largest or main living space to a minimum of 18degC, even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat requirements to be fixed (i.e., not portable) and at minimum 1.5 kW in heating capacity, and meet the minimum capacity for heating required for the main living space. The Heating Assessment Tool can be used to check if the existing fixed heater(s) are sufficient or whether you will need to "top up" by adding a second heater. Fires that are open and unflued heaters like small portable LPG bottle heaters are not considered acceptable heating options under those following the Healthy Homes Standard.

If the heating you provide is an electric heater or heat source, then it must be equipped with a thermostat. This makes the heating more reliable and efficient. In most houses, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in certain instances like small apartments, a smaller fixed electric heater could be enough.

If your living space already has a central heating source such as an air conditioner, it could require an update to be able to meet the standards. Certain kinds of heaters cannot be used to achieve the standard since they’re either expensive, inefficient and/or unhealthy to run.

Ventilation Ahuriri

Each living space within the rental property should have at least one openable windows or an exterior door to offer natural airflow. Furthermore, moist areas such as kitchens or bathrooms should have an externally vented extractor fan that can take moisture away.

This ventilation quality is all about understanding the fact that dried air can be much easier to heat and that a well ventilated rental property is less likely to be a victim of damp and mould.

Living rooms, bedrooms, kitchens, and dining rooms are considered to be liveable spaces. Connecting spaces like the hallway aren’t living spaces and therefore don’t need an opening door or window.

Each door, window or the skylight needs for them to be in a position open to the outside while remaining closed in order to allow the circulation of fresh air and ventilation.

Bathrooms, kitchens, and every other room of your home that has a bath, shower cooker or any other moisture-producing item will need adequate extractor fans which are vented to the outdoors. Insulation Ahuriri

Insulation for underfloor and ceilings is mandatory on all rental houses since 1 July 2019. Property managers and landlords have to ensure that the insulation is in line with standards that are in line with the latest standard. In some cases, old ceiling insulation as well as insulation within the subfloor space might require to be replaced or replaced.
